HomeMy WebLinkAboutR11-014 Transfer and Assignment of Funds Mccoy Creek Cabin Commissioner moved adoption of the following Resolution: BOARD OF COUNTY COMMISSIONERS COUNTY OF EAGLE, STATE OF COLORADO RESOLUTION NO. 2011 - © / 4 -/ RESOLUTION AUTHORIZING THE TRANSFER AND ASSIGNMENT OF FUNDS TO BE PAID AS A RESULT OF McCOY CREEK CABINS PLANNED UNIT DEVELOPMENT SKETCH/PRELIMINARY PLAN AND ZONE CHANGE FROM EAGLE COUNTY, COLORADO TO THE EAGLE COUNTY HOUSING AND DEVELOPMENT AUTHORITY WHEREAS, Eagle County, Colorado ( "County') is a political subdivision of the State of Colorado with all the powers granted to statutory counties; and WHEREAS, Eagle County Housing and Development Authority ( "ECHDA ") is a body corporate and politic, authorized pursuant to C.R.S. 29 -4 -501, whose purpose is the development of housing for the residents of Eagle County; and WHEREAS, by Resolution No. 2008 -056 the Board of County Commissioners approved the McCoy Creek Cabins Planned Unit Development Sketch/Preliminary Plan and Zone Change (File No. PDSP- 00027;ZC- 00091); and WHEREAS, the McCoy Creek Cabins Planned Unit Development Sketch/Preliminary Plan and Zone Change was approved with conditions as set forth in Resolution No. 2008 -056; and WHEREAS, condition number 15 of Resolution No. 2008 -056 provides in part that "the applicant or any subsequent purchasers of lots 1, 2 or 3, or any successor in interest to the applicant or subsequent purchaser or assigns thereof, shall, in a form approved by the Eagle County Attorney's Office, pay the following to Eagle County: (a) $83,333.33 upon the issuance of the first building permit for lot 1; (b)$83,333,33 upon the issuance of the first building permit for lot 2; and (c) $83,333.33 upon the issuance of the first building permit for lot 3 "; and WHEREAS, condition number 15 of Resolution No. 2008 -056 is to satisfy housing requirements; and WHEREAS, County desires to transfer and assign such funds which are required to be paid to County pursuant to condition number 15 of Resolution No. 2008 -056 to ECHDA for use in the development of housing or any other authorized purpose. Page 1 of 2 • NOW THEREFORE BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO: THAT, the County hereby authorizes the transfer and assignment of funds which are required to be paid to County pursuant to condition number 15 of Resolution No. 2008 -056 to the Eagle County Housing and Development Authority to be used for the development of housing or any other authorized purpose. THAT, the Board hereby finds, determines and declares that this Resolution is necessary for the public health, safety and welfare of the residents of the County of Eagle, State of Colorado.
