HomeMy WebLinkAboutR10-127 Proposition 101 and Amends 60 and 61 Opposition Commissioner moved adoption of the followin g 'Resolution: BOARD OF COUNTY COMMISSIONERS COUNTY OF EAGLE, STATE OF COLORADO RESOLUTION NO. 2010 - 1 2-1 A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF EAGLE COUNTY OPPOSING PROPOSITION 101 AND AMENDMENTS 60 AND 61 WHEREAS, the Elected Officials of Eagle County respect our citizens and work diligently to efficiently utilize the resources we receive from our taxpayers; and WHEREAS, Eagle County operates under a balanced budget, not spending more than its revenues; and WHEREAS, during this current economic downturn Eagle County has already felt the impact of reduced revenues and an increased need for certain county services; and WHEREAS, Eagle County will be facing a 30% decrease in property tax revenue, has seen a 75% decrease in investment and interest income over the last two years, and anticipates flattened sales tax, permit and fee revenue; and WHEREAS, the Elected Officials of Eagle County recognize the desire and need for a more efficient government that gives greater value to taxpayers in this economic climate; and WHEREAS, with the aid of internal and external experts as well as citizen advisory boards, Eagle County has made dramatic cuts in its budget, including but not limited to: freezing payroll, reducing staff through attrition, early retirement and layoffs by 16% or 70 positions since 2008; and reducing expenses by 26.8% or 11.2 million by 2012; and WHEREAS, state voters will be presented with the opportunity at the November 2 statewide general election to protect the fiscal health of our local government by defeating Proposition 101, Amendment 60 and Amendment 61; and WHEREAS, Eagle County believes every citizen voting in this election should be provided complete and accurate information on the impacts of these measures on services they expect and depend on before they vote; and WHEREAS, these three ballot measures, individually and collectively, significantly reduce or otherwise restrict both state and local revenues in a number of different ways including but not limited to: property taxes, specific ownership taxes, telecommunication taxes, state income taxes, state shared revenues to assist counties with local road and transit improvements, and other state grants and loans to help local governments; and WHEREAS, one of the components of Amendment 60 would overturn election decisions made by and spending Eagle County and other voters over the past eighteen years regarding revenue an s e d Y g Y p g Y g g p g by Eagle County government, creating financial chaos and uncertainty for local communities; and WHEREAS, Proposition 101 reduces the vehicle registration fee (annual license plate fee) to a level which would destroy Eagle County's ability to maintain safe roads and bridges, by lowering the fee to the assessment rate from the year 1919; and WHEREAS, Colorado maintains one of the lowest national rankings in K -12 spending as a percentage of personal income and in teacher salary compared to other occupations'; and WHEREAS, Amendment 60 would cut property taxes supporting our public schools in half, which would represent an additional loss to the schools state -wide of an estimated 1.5 billion dollars, with Eagle County's revenue share dropping from $479 per pupil to $5.02 per pupil and WHEREAS, Amendment 61 would eliminate viable cost effective local funding options for capital improvements like public safety facilities, road and bridge projects, jails, fire stations, community centers, libraries, energy conservation improvements, airport improvement projects, hospitals, water and sanitation facilities, and public school improvements; and WHEREAS, Amendment 61 would require voter approval of routine, minor, and economically advantageous leases for such items as copiers, computer equipment, building space, and sheriff vehicles adding additional costs to the use of such items; and WHEREAS, if these initiatives are approved by the voters, Eagle County government will suffer a permanent annual budget reduction of approximately $24 million after the completion of the four -year phase -in period; and WHEREAS, such reduction includes a permanent annual revenue cut of approximately 63.5% or $20.5 million in the General Fund; a permanent annual revenue cut of approximately 46% or $3 million in the Road and Bridge Fund; and a permanent annual revenue cut of approximately 5% or $345 thousand in the ECO Fund; and WHEREAS, these initiatives annually cut vehicle licensing fee revenue for all local governments by 83% or 3 million dollars, revenue which supports services in the County Clerk's office, emergency medical response, police officer training, and the states motor vehicle insurance database and WHEREAS, these initiatives annually cut vehicle ownership tax revenue for all local governments by 99% or approximately 7 million dollars, revenue which supports schools, towns, CMC, fire districts, hospitals, libraries and water and sanitation districts and WHEREAS, services and programs in Eagle County will be limited or curtailed because of the numerous restrictions and revenue reductions proposed by these three measures, including but not limited to: road and bridge operations limited to emergency repairs and maintenance; limited or no snowplowing in many areas; reduced or eliminated law enforcement and emergency personnel 'According to the Center on Budget and Policy Priorities, Colorado was ranked 48 nationally in 2008 for K -12 spending as a percentage of personal income and was ranked 49 nationally in 2007 for teacher salary compared to average pay in other occupations. 2 Information provided by The Bell Policy Center. 3 Information provided by The Bell Policy Center. a Information provided by The Bell Policy Center. throughout the county; reduced or eliminated child welfare, food assistance, veteran services, substance abuse, mental health, adult protection and job assistance programs; reduced or eliminated department of health and environment programs; reduced or eliminated use of County facilities such as the solid waste landfill, the county fairgrounds, and the County fair; reduced or eliminated funding for community organizations; and greatly lengthened customer service /waiting times in county offices; and WHEREAS, the cumulative impact of these three ballot initiatives will adversely affect the quality of life for all residents of Eagle County for many years to come by reducing public support for parks, trails, open space, local charities and non - profits; and WHEREAS, the failure to attract and maintain good quality jobs will lead to declining property values and further reduce the ability of Eagle County government to maintain public safety and to deliver other critical and mandated services to our citizens and taxpayers; and WHEREAS, a number of prominent individuals, newspapers and organizations are voicing opposition to these measures as not being in the best interests of Colorado and of local communities, including Colorado Counties, Inc., Club 20, the Colorado Association of Homebuilders, the Colorado Association of Commerce and Industry, the Colorado Farm Bureau, the Colorado Education Association, the Economic Development Council of Colorado, Colorado Ski Country USA, and those entities listed on the attached Exhibit A; and WHEREAS, Eagle County's Elected Officials consider the potential impacts of the proposed ballot issues to be a matter of official County and State -wide concern; and WHEREAS, provisions of state law allow Eagle County to put forth this resolution as a statement of opposition to the measures known as Proposition 101, Amendment 60 and Amendment 61.
