RESOLUTION NO. 2010- ( I
FINAL RELEASE OF COLLATERAL
AND
TERMINATION OF THE WARRANTY PERIOD
AND
TERMINATION OF THE
SUBDIVISION IMPROVEMENTS AGREEMENT
FOR
PINON PINES SUBDIVISION I
WHEREAS, on or about October 22, 1991, the Board of County Commissioners of the
County of Eagle, State of Colorado ( "Board ") entered into a Subdivision Improvements
Agreement with Jack Schuss ( "Subdivider ") as a condition of final plat approval for Pinon Pines
Subdivision I; and
WHEREAS, pursuant to the Agreement, the Subdivider provided collateral in the form
of cash in the amount of $2,000.00; and
WHEREAS, by Resolution No. 92 -57 the Board authorized the partial release of
collateral in the amount of $1,800.00, thereby reducing the collateral to $200.00 as sufficient
collateral for the two -year warranty period; and
WHEREAS, the Engineering Department by Memorandum dated April 25, 1994
(Exhibit A) stated that the two -year warranty period had been successfully completed and
recommended the remaining collateral of $200 be released; and
WHEREAS, the County has been unable to locate the resolution releasing the collateral
and terminating the Subdivision Improvement Agreement; and
WHEREAS, the County, by this resolution, is hereby releasing the collateral and
terminating the Subdivision Improvements Agreement for Pinon Pines Subdivision I.

NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO: .
THAT, based upon the oral and written recommendations of the County Engineer and
County Attorney, THE BOARD FINDS that the Subdivider's obligations under the Agreement
have been satisfied.
THAT, the Board hereby authorizes the full and final release of the Subdivision
Improvements Agreement for Pinon Pines Subdivision I.
THAT, this document shall be recorded in the records of the Eagle County Clerk and

Recorder, which shall be evidence that the Subdivision Improvements Agreement for Pinon
Pines Subdivision I is hereby released.

RE: Pinon Pines Subdivision I
Subdivision Improvements Agreement
Expiration of Two Year Correction Period
On Thursday, April 25, 1994, I inspected the public improvements
constructed and collateralized as part of the above referenced
Subdivision Improvements Agreement.
I observed no workmanship or materials failures. We recommend
that the remaining collateral of $200.00, which we are holding
for the two year correction period, be released.
