COUNTY OF EAGLE, STATE OF COLORADO
RESOLUTION NO. 2010- 9
RELEASE OF LETTER OF CREDIT NO. 70110058
FOR ROAD CUT PERMIT NO. 3668
FRITZ AND CECILIA SCHMIDT
• WHEREAS, on or about September 5, 2008, the Board of County Commissioners of the
County of Eagle, State of Colorado ("Board") granted Road Cut Permit No. 3668 to Fritz and
Cecilia Schmidt (Subdivider); and
WHEREAS, the Subdivider provided collateral in the form of Letter of Credit No.
7011058 issued by Millennium Bank in the amount of $2,000.00 to guarantee the faithful
completion of the construction project; and
WHEREAS, both the Subdivider and the Engineering Department state that the work
performed under Construction in the Public Way Permit #3668, 5458 Bellyache Ridge Road,
Bellyache Ridge Subdivision, Wolcott, Colorado is satisfactory and has successfully completed
the two year warranty period (Exhibit "A ").
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO:
THAT, based upon the oral and written recommendations of the County Engineer and
County Attorney, THE BOARD FINDS that the work performed under Construction in the
Public Way Permit #3668, 5458 Bellyache Ridge Road, Bellyache Ridge Subdivision, Wolcott,
Colorado is satisfactory and has successfully completed the two year warranty period.
THAT, the Board hereby authorizes the full and final release of the collateral and Letter
of Credit No. 70110058 be terminated and that the same be returned to the Subdivider.
MOVED, READ AND ADOPTED by the Board of County Commissioners of the
County of Eagle, State of Colorado, at its regular meeting held the . day of August, 2010.

Inspection was made August 9, 2010 of the work performed under Construction in the Public
Way Permit #3670, 121 Corral Road, Singletree Subdivision, Edwards, CO.
The work is satisfactory and has successfully completed the two year warranty period under the
requirements of the permit. Release of the Letter of Credit as collateral is recommended.
