BOARD OF COUNTY COMMISSIONERS
COUNTY OF EAGLE, STATE OF COLORADO
RESOLUTION N0.2010 -
APPOINTING COUNTY REPRESENTATIVES TO DETERMINE APPORTIONMENT
OF FEDERAL MONEYS FROM PUBLIC LANDS
RECITALS
WHEREAS, The Board of County Commissioner for Eagle County, Colorado
(hereinafter "County") receives annual funds from the United States Forest Service ("Payment")
per C.R.S. §30-29-101, et seq.; and
WHEREAS, the County shall allocate a minimum of twenty-five percent (25%) of the
Payment to the county road and bridge fund and a minimum of twenty-five percent (25%) to the
public schools in the county; except that the county may allocate less than twenty-five percent
(25%) of the Payment to the county road and bridge fund in order to maximize the receipt by the
county of federal payments in lieu of taxes; and
WHEREAS, the allocation of the remaining fifty percent (50%) of the Payment shall be
determined by three representatives from the school district and three representatives from the
County; and
WHEREAS, the County is now desirous of appointing its representatives for the above-
stated purpose.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO:
THAT, Keith Montag, County Manager; John Lewis, County Finance Director: and Brad
Higgins, County Road and Bridge Director are hereby appointed as the County's representatives
per C.R.S. §30-29-101(3)(b)(I).
THAT, the County's representatives are authorized to meet with representatives from the
school districts within Eagle County and negotiate the remaining percentage allocation of the
Payment to either the public schools in the county or the county road and bridge fund.
THAT, the representatives are directed to maximize the total amount of federal funds
that inay be received by the County and the public schools.
THAT, the Board hereby finds, determines and declares that this Resolution is necessary
for the public health, safety and welfare of the residents of the County of Eagle, State of
Colorado.
MOVED, READ AND ADOPTED by the Board of County Commissioners of the
County of Eagle, State of Colorado, at its regular meeting held the ~`h day of March, 2010.
