DEED RESTRICTIONS AND OTHER DOCUMENTS RELEVANT TO THE CLOSING OF DEED- RESTIt~[CTED UNITS AT STRATTON FLATS. WHEREAS, Eagle County Housing and Development Authority contracted with Stratton Flats, LLC to produce and deliver units at Stratton Flats containing deed- restrictions (the "Contract"); WHEREAS, in the course of performance of the Contract, the Eagle County Housing and Development Authority executes each deed restriction prior to .its recordation; and WHEREAS, Stratton Flats, LLC and the Authority wish to ensure that all documents are timely signed by the Authority to expedite closing of deed-restricted units at Stratton Flats. NOW, THEREFORE, BE IT RESOLVED BY THE EAGLE COUNTY HOUSING AND DEVELOPMENT AUTHORITY, BY AND THROUGH .ITS CHAIRMAN: THAT, the Board of Commissioners of the Eagle County Housing and Development Authority hereby authorizes the Chairman of the Board to execute on its behalf any and all necessary documents, instruments, papers or other forms relevant to the closing of deed-restricted units at Stratton Flats. THAT, in the event the Chairman is not available to execute any and all relevant documents, instruments, papers or other forms, then any other Housing and Development Authority Commissioner is hereby authorized to execute such documents on behalf of the Board for the Eagle County Housing and Development Authority. THAT, this Resolution is necessary for the public health, safety and welfare of the residents of the County ~of Eagle, State of Colorado. THAT, this Resolution applies retroactively and prospectively to all deed restrictions running with property at Stratton Flats already executed by a Commissioner of the Eagle County Housing and Development Authority.
