HomeMy WebLinkAboutR09-033 I-70 Edwards Interchange Upgrade ProjCommissioner ~ moved adoption of the foil wing Resolution: BOARD OF COUNTY COMMISSIONERS COUNTY OF EAGLE, STATE OF COLORADO RESOLUTION N0.2009 - d ~ 3 A RESOLUTION DESCRIBING PROPERTY TO BE ACQUIRED BY EAGLE COUNTY, COLORADO FOR THE I-70 EDWARDS INTERCHANGE UPGRADE PROJECT WHEREAS, Eagle County, in conjunction with the Edwards Area Metropolitan Districts, are developing plans for road improvements of the I-70G Spur Road between the intersection of Beard/Berry Creek Roads intersection and the Miller Ranch Road! I-70G Spur Road intersection; and WHEREAS, Acquiring right-of-way, permanent easements and temporary construction easements is necessary for construction and completion of said project; and WHEREAS, The Board of County Commissioners acting on behalf of Eagle County, Colorado is authorized to acquire property for highways by 43-2-112 C.R.S; and WHEREAS, The Board of County Commissioners wishes to acquire certain real property and any structures or improvements thereon, permanent easements and temporary construction easements for the purpose of this project as will be described by the final right-of- way plans for the I-70 Edwards Interchange Upgrade Project as approved by the Colorado Department of Transportation. It is anticipated that the necessary right-of-way and easements are closely described by Exhibit "A-M" but that small changes may be required as the design of the Improvements is finalized. It is further anticipated that certain parcels identified in Exhibit "A-M" will be acquired by the County and subsequently conveyed to the Colorado Department of Transportation; and WHEREAS, Eagle County staff will negotiate with the property owners of said parcels as shown on the right-of-way plan as depicted by Exhibit "A-M" in accordance to Colorado Revised Statutes including the Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970, as amended, also known as the Uniform Act, and applicable policies and procedures set forth in Colorado Department of Transportation Right of Way Manual: NOW, THEREFORE be it resolved by the Board of County Commissioners of the County of Eagle, State of Colorado: THAT, it is necessary to acquire the fee simple absolute title of property in addition to permanent easements and temporary construction easements as will be described by the final right-of-way plans for the I-70 Edwards Interchange Upgrade Project as approved by the Colorado Department of Transportation. It is anticipated that the necessary right-of-way and easements are closely described by Exhibit "A-M" but that small changes may be required as the design of the Improvements is finalized; and THAT, Eagle County has estimated the total cost of the project and is prepared to accept the state funding for the same. Therefore, Eagle County authorizes the execution of a contract with the Colorado Department of Transportation to complete the work under the project; and THAT, after exhausting all possible avenues for a negotiated purchase, Eagle County is prepared to exercise any and all of its statutory acquisition powers, including the power of eminent domain for this necessary project.
