of the following Resolution:
BOARD OF COUNTY COMMISSIONERS
COUNTY OF EAGLE, STATE OF COLORADO
RESOLUTION NO. 2004-
RESOLUTION AUTHORIZING THE CHAIRMAN OF THE BOARD OF THE EAGLE
COUNTY BOARD OF COUNTY COMMISSIONERS TO AUTHORIZE
COMMENCEMENT OF WARRANTY AND /OR CORRECTION PERIODS FOR
ANY AND ALL PUBLIC IMPROVEMENTS WITHIN EAGLE COUNTY, COLORADO
WHEREAS, the Board of County Commissioners of the County of Eagle, State of
Colorado ("Board") is authorized to enter into Agreements for various public improvements
within Eagle County, Colorado (hereinafter "Agreement "); and
WHEREAS, the Subdivider and/or Contractor may be obligated to provide sufficient
collateral, bonds or other security in the judgment of the Board to make reasonable provisions for
completion of the project and public improvements; and
WHEREAS, pursuant to the Agreements and upon the date all the work required is
completed and accepted and a hearing on final settlement, if applicable, has been held by the
Board, the warranty or correction period may be commenced; and
WHEREAS, the Board wishes to expedite the commencement of the warranty or
correction period by authorizing the commencement of the warranty or correction period by
Consent of the Chairman of the Board of County Commissioners, the County Attorney and the
respective County Department Director; and
THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO:
THAT, the Board will delegate to the Chairman of the Board, or in his absence, the
Chairman Pro -Tem, the power to approve commencement of warranty or correction periods once
the commencement of the warranty or correction period has been recommended for approval by
the respective County Department and the County Attorney.
THAT, pursuant to the Agreement, the Board will retain the performance bond and
material and labor bonds or other security for the duration of the warranty or correction period;
and
THAT, the warranty or correction period for the project shall commence on the date all
work required under the Agreement is complete and accepted, as determined by the County and
the respective County Department Director.

THAT, the Board by this Resolution hereby ratifies and retroactively authorizes any and
all warranty or correction periods commenced prior to the signing of this resolution; and
THAT, this resolution shall become effective upon its approval and signature by the
Board of County Commissioners.
