ZC -00068 and PDP -00027 WHEREAS, on or about April 21, 2004 the County of Eagle, State of Colorado, accepted for filing applications submitted by Vail Christian Schools and the Eagle River Water and Sanitation District, (hereinafter "Applicant ") to re -zone the herein described property in Eagle County from the Resource [R] Zone District to the Planned Unit Development [PUD] Zone District per File No. ZC- 00068, and for approval of the Planned Unit Development Preliminary Plan for the Vail Christian High School Planned Unit Development, File No. PDP- 00027; and, WHEREAS, the Applicant requested the approval of a Planned Unit Development (PUD) Preliminary Plan and Zone Change which will allow a mixed -use development consisting of: A 7.278 acre campus for the Vail Christian High School with up to 70,000 square feet of building area; a 5.023 acre site for an interfaith chapel and community outreach facility of up to 22,500 square feet; a 1.897 acre commercial office/ retail site for of up to 20,000 square feet; 119.50 acres of designated private Open Space, and; 66.6 acres of land underlying various public rights -of -way and the Union Pacific Railroad. In total, the subject property consists of 205.40 acres of which 58% is designated as private Open Space. WHEREAS, notice of the Zone Change and Preliminary Plan was given to all proper agencies and departments as required by the Eagle County Land Use Regulations, Section 5- 210.E; and, WHEREAS, at its public hearing held on July 7, 2004, the Eagle County Planning Commission, based upon its findings, unanimously recommended approval of the proposed zone change and the proposed PUD Preliminary Plan, as conditioned; and 1 WHEREAS, at its regular hearing of July 27, 2004, the Eagle County Board of Commissioners (hereinafter "Board"), considered the proposed zone change and PUD Preliminary Plan; associated plans; and the statements and concerns of the Applicant, the Eagle County Community Development and Engineering staff, and other interested persons; and the recommendation of the Eagle County Planning Commission. BASED ON THE EVIDENCE BEFORE IT, and with the modifications imposed by the conditions hereinafter described, THE BOARD FINDS AS FOLLOWS: Pursuant to Eagle County Land Use Regulations Section 5-240.F.3.e. Standards for the review of a PUD Preliminary Plan: 1. Unified ownership or control. [Section 5-240.F.3.e (1)] -The title to all land that is part of a PUD is owned or controlled by one (1) person. 2. Uses. [Section 5-240.F.3.e (2)] -The uses that maybe developed in the PUD are those uses that are designated as uses that are allowed, allowed as a special use or allowed as a limited use in Table 3-300, "Residential, Agricultural and Resource Zone Districts Use Schedule" for the zone district designation in effect for the property at the time of the application for PUD with the exception of Commercial Uses. The Board has authorized the Commercial Use variation. Dimensional Limitations. [Section 5-240.F.3.e (3)] -The dimensional limitations that shall apply to the PUD are not those specified in Table 3-340, "Schedule of Dimensional Limitations", for the zone district designation in effect for the property at the time of the application for PUD. The Board has granted a variation from the dimensional limitation to allow a singular point of ingress & egress to each proposed Planning Parcel pursuant to Section 5-240 F.3.f., Variations Authorized. 4. Off-Street Parking and Loadi~zg. [Section 5-240.F.3.e (4)] - It has been demonstrated that off-street parking and loading provided in the PUD complies with the standards of Article 4, Division 1, Off-Street Parkin~~and Loading Standards, without a necessity for a reduction in the standards. 5. Landscaping. [Section 5-240.F.3.e (5)] - It has been demonstrated that the landscaping proposed for the PUD complies with the standards of Article 4, Division 2, Landscaping and Illumination Standards. 6. Signs. [Section 5-240.F.3.e (6)] - As conditioned and unless specified in the PUD Guide, the signs within the PUD will be as specified in Article 4, Division 3, Simon 2 Regulations. 7. Adequate Facilities. [Section 5-240.F.3.e (7)] - It has been demonstrated that the development proposed in the PUD Preliminary Plan will be provided adequate facilities for potable water supply, sewage disposal, solid waste disposal, electrical supply, fire protection and roads and will be conveniently located in relation to schools, police and fire protection, and emergency medical services. 8. Improvements. [Section 5-240.F.3.e (8)] - It has been clearly demonstrated that the improvements standards applicable to the development will be as specified in Article 4, Division 6, Improvements Standards regarding: (a) safe, efficient access, (b) internal pathways, (c) emergency vehicles, (d) principal access points, and (e) snow storage. 9. Compatibility With Surrounding Land Uses. [Section 5-240.F.3.e (9)] -The development proposed for the PUD is compatible with the character of surrounding land uses. 10. Consistency with Master Plan. [Section 5-240.F.3.e (10)] -The PUD is consistent with the Master Plan, and is consistent with the Future Land Use Map (FLUM). 11. Phasing. [Section 5-240.F.3.e (11)] - A phasing plan is not required for this development; however, cost estimates for all required public improvements, sufficiently detailed to the satisfaction of the Eagle County Engineer are required prior to Final Plat approval. Guarantees for all public improvements, will be required with the Final Plat approval. 12. Common Recreation and Open Space. [Section 5-240.F.3.e (12)] - As conditioned, the applicant has demonstrated that the PUD will comply with the common recreation and open space standards with respect to: (a) minimum area; (b) improvements required; (c) continuing use and maintenance; or (d) organization. 13. Natural Resource Protection. [Section 5-240.F.3.e (13)] -The PUD does demonstrate that the recommendations made by the applicable analysis documents available at the time the application was submitted, as well as the recommendations of referral agencies as specified in Article 4, Division 4, Natural Resource Protection Standards, have been considered. Pursuant to Eagle County Land Use Regulations Section 5-280.B.3.e. Standards for the review of a Preliminary Plan for Subdivision: 14. Consistent with Master Plan. [Section 5-280.B.3.e (1)] -The proposed subdivision is consistent with the Master Plan, and IS consistent with the Future Land Use Map (FLUM). 15. Consistent with Land Use Regulatio~as. [Section 5-280.B.3.e (2)] - It has been demonstrated that the proposed subdivision complies with all of the standards of this Section and all other provisions of these Land Use Regulations, including, but not limited to, the applicable standards of Article 3, Zone Districts, and Article 4, Site Development Standards. The roadway improvement standards applicable to the development will be as specified in Article 4, Division 6, Improvement Standards with the exception of the requirement for two points of ingress & egress to each Planning Parcel. 16. Spatial Pattern Shall Be Efficient. [Section 5-280.B.3.e (3)] -The proposed subdivision is located and designed to avoid creating spatial patterns that cause inefficiencies in the delivery of public services, or require duplication or premature extension of public facilities, or result in a "leapfrog" pattern of development. 17. Suitability for Development. [Section 5-280.B.3.e (4)] -The property proposed to be subdivided is suitable for development, considering its topography, environmental resources and natural or man-made hazards that may affect the potential development of the property, and existing and probable future public improvements to the area. 18. Compatible With Surrounding Uses. [Section 5-280.B.3.e (5)] -The proposed subdivision is compatible with the character of existing land uses in the area and shall not adversely affect the future development of the surrounding area. Pursuant to Eagle County Land Use Regulations Section 5-240.F.2.a.(8), Initiation: 19. The Applicant has submitted a PUD Guide that demonstrates that the requirements of this Section have been fully met. Furthermore, the Applicant has demonstrated that the purposes of PUD zoning are being served by the proposed development. Pursuant to Eagle County Land Use Regulations, Section 5-230.D., Standards for determining whether to adopt, adopt with modifications, or disapprove the proposed amendment to the Official Zone District Map: 20. Consistency With Master Plan. The proposed uses are consistent with the purposes, goals, policies and FLUM of the Master Plan. 4 21. Compatible witli surrounding uses. The proposed uses are compatible with existing and proposed uses surrounding the subject land, and it is an appropriate zone district for the land, considering its consistency with the purpose and standards of the proposed zone district. 22. Changed conditions. There are changed conditions that require a change in zone district, as proposed. 23. Effect on natural environment. The proposed uses will not result in significantly adverse impacts on the natural environment, including but not limited to water, air, noise, stormwater management, wildlife habitat, vegetation, and wetlands. 24. Community need. The proposed uses will meet a community need. 25. Development patterns. The proposed uses will result in a logical and orderly development pattern, will not constitute spot zoning, and can logically be provided with necessary public facilities and services. 26. Public interest. The area to which the proposed zone change will apply has changed or is changing to such a degree that it is in the public interest to encourage a new use or density in the area. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO: THAT, the petition of Vail Christian Schools and the Eagle River Water and Sanitation District, File No. ZC-00068, for a Zoning Amendment to change from the Resource [R] Zone District to the Planned Unit Development [PUD] Zone District be and is hereby approved for the subject property located in the unincorporated area of Eagle County and as described in Exhibit `A' of this Resolution; THAT, the Board of County Commissioners directs the Director of Community Development to enter this amendment on the appropriate page of the Official Zone District Map and provide a copy of this Resolution to the Applicant; 1) THAT, subject to the conditions set forth below, the application for the Planned Unit Development Preliminary Plan for the Vail Christian High School PUD be and is hereby approved: a) That all material representations made by the Applicant in submitted materials and in public meetings shall be adhered to and considered conditions of approval, unless otherwise amended by other conditions; b) That prior to recording, the PUD Guide be amended to specify a maximum allowed height and minimum setbacks from property line for each proposed monument sign; c) That prior to recording, the PUD Guide be amended to incorporate the required use of bear-proof trash containers within the development; d) That the County Engineering Department's comments of July 16, 2004, except comments `8' and `13' therein, be adequately addressed to the satisfaction of the County Engineer prior to Final Plat approval. e) That the Eagle River Fire Protection District's comments of May 30, 2004 be adequately addressed prior to Final Plat approval; f) That prior to recording, the PUD Guide be amended to include provisions for the continuing use and maintenance responsibility of the open space within the development; g) Tracts `E', `F', `G', `J', `K', and `L', as defined on the PUD Preliminary Plat, attached hereto as Exhibit `B' shall be conveyed to Eagle County in fee simple at the time of Final Plat; h) A blanket easement shall be granted to Eagle County across Tract `C', as defined on the PUD Preliminary Plat, attached hereto as Exhibit `B', for the purpose of the Core Bicycle Trail alignment, with encroachment into Tract `C' to be minimized to the greatest extent practicable. This will be achieved through a separate agreement to be recorded at Final Plat; i) The applicant shall not be required to provide public fishing or access on the subject property. Tract `F', which will be conveyed to Eagle County, will accommodate public access to the Eagle River; j) The Eagle County Attorney's Office shall determine if the Eagle River Water and Sanitation District is a governmental entity that is exempt from the recommendations of the Eagle County Housing Guidelines. If the District is not exempt then, the applicant must provide to the Eagle County Director of Housing a Housing Plan with the Final Plat application. The Housing Plan shall be specific to Lot 3 and the Eagle 6 River Water and Sanitation District and meet with the Director's satisfaction; k) The Applicant's Attorney and the Eagle County Attorney shall draft deed restriction language that will permanently preserve Tract `A' and Tract `C' as private Open Space, as defined on the Preliminary Plat attached hereto as Exhibit `B'; 1) Eagle County shall work with the Applicant to provide a parking area for up to six (6) automobiles within Tract `K' (Red Canyon Road) for the purpose of fisherman access for the Cordillera Property Owner's Association; m} Eagle County is committed to properly posting Tract `F' with a sign(s) to prevent public fishing access west of Hillcrest Drive; n) Public fishing access shall be allowed on Lot 3, within and along the southern bank the Eagle River up to the southernmost boundary of the 100-year floodplain. Eagle County will restrict public access onto Lot 3 beyond the southernmost boundary of the 100-year floodplain by posting the property with a sign or signs as maybe necessary. The Eagle River Water and Sanitation District may also choose to erect a fence to further discourage trespass. THAT, the Vail Christian High School Preliminary Plat attached hereto as Exhibit `B' be and is hereby approved; THAT, the Vail Christian High School PUD Guide dated August 10, 2004 attached hereto as Exhibit `C' be and is hereby approved. THE BOARD further finds, determines and declares that this Resolution is necessary for the health, safety and welfare of the inhabitants of the County of Eagle, State of Colorado. This PUD Guide sets forth the land uses and development standards for all lands located within the property known as the Vail Christian High School Planned Unit Development ("VCHS PUD") and as described in the Vail Christian High School Preliminary Plan. This Guide defines the permitted use of land; regulates the bulk, height, minimum site area, minimum site width, minimum and maximum yard spaces for structures; provides for existing transportation corridors, open space and recreational areas; and provides additional supplementary regulations. This Guide is authorized pursuant to Resolution _-_ approving the Preliminary Plan and Zone Change for the Vail Christian High School. This Guide is intended to replace the standard zoning provisions contained in Chapter II of the Eagle County Land Use Regulations. The specific provisions of this Guide shall supersede those of the Eagle County Land Use Regulations. Where the Guide is silent the provisions of the Land Use Regulations shall govern. Section 1.02: Purpose. The primary purpose of this Guide is to reiterate and clarify the standards, restrictions and regulations which govern development and land use within the lands made part of the VCHS PUD and to incorporate into this Guide any amendments hereto approved by the Board of County Commissioners ("BOCC") for Eagle County, Colorado. Additionally, the purpose of this Guide is to insure that the VCHS PUD is developed pursuant to the land uses as identified in the Preliminary Plan and described herein. The Guide will insure the orderly and compatible development of the property. The Guide supplements the standard zoning provisions of Eagle County with site specific restrictions that are more appropriate to the specific conditions of lands contained within this development. Section 1.03: Intent. The VCHS PUD is intended to be a balanced development that incorporates land uses including one commercial/religious/church site, a school/religious/church site, existing transportation corridors, open space and recreation, and utility structures. This Guide remains somewhat flexible to allow for changes and innovations in specific design as the project progresses through its operational life cycle. These changes will be permitted only as they remain consistent with the overall character and standards, as defined throughout this Guide and as approved by the BOCC. 1 Vail Christian High School PUD Section 1.04: Enforcement. The provisions of this Guide are enforceable by the authority and powers of Eagle County, as granted by law. Enforcement action shall be consistent with the authority and actions defined in the Eagle County Land Use Regulations. All provisions of this Guide shall run in favor of the residents, occupants and owners of land within the VCHS PUD to the extent expressly provided in this Guide and in accordance with its terms and conditions. Section 1.05: Planning_ Parcel. All areas within the VCHS PUD belong to at least one planning parcel [See Illustration 3]. Each planning parcel is described herein and defines specific land uses and development standards. Section 1.06.• Conflict. The specific provisions of this Guide shall supersede those of the Eagle County Land Use Regulations. However, where the Guide does not address and issue, the specific provisions of the Eagle County Land Use Regulations shall prevail. In cases of dispute or ambiguity, the BOCC shall act to interpret. Section 1.07: Incorporation of Preliminary Plan• The Preliminary Plan for the VCHS PUD, as contained within the Preliminary Plan application shall be used as a general guide in the development of the project. It is anticipated that modifications to this Guide will he necessary from time to time as the project progresses through its development life. This Guide provides two types of modifications: Major and Minor. These two are defined as follows: Section 1.07.02 Major Modifications. Major modifications shall require amendments to the PUD Preliminary Plan. Major modifications are those changes which could alter the character or land use of portion of the project. Major modifications shall be defined and processed in accordance with Section 5-240.F.3.m, Amendment to Preliminary Plan for PUD, of the Eagle County Land Use Regulations. Section 1.07.03 Minor Modifications. Minor modifications are Those changes which will not alter the original concept of the project but which may result in a change in design of the development. Minor modifications include, but are not limited to additions of land uses not previously itemized in this Guide and minor shifts in lot locations, provided that the changes are similar in nature to the listed permitted uses and are consistent with the intent, and adjustments to Planning Parcel boundaries. Applications for Minor Modifications shall be processed in accordance with Section 5-300. Limited Review Use of the 2 Vail Christian High School PUD Eagle County Land Use Regulations and maybe approved if it is found to be consistent with the established goals of this Guide and Preliminary Plan for the Eagle River Parcel. In addition, Minor Modifications may or may not require an Amended Final Plat, processed in accordance with Section 5-290, Minor Subdivision, of the Eagle County Land Use Regulations. Section 1.07.04 Appeals. Appeals of any decision hereunder by the Director maybe made to the Board of County Commissioners within 10 days and pursuant to applicable administrative processes. Section 1.08: Parkin. All parking shall comply with Article 4 -Site Development Standards of the Eagle County Land Use Regulations or with the specific parking standards detailed on the Overall Development Plan (Illustration 4). Section 1.09: Impact Control. The following impact restrictions apply: 0. Wood Burning Devices. All wood burning devices shall conform to the ECLUR. 0. Landscaping. Adequate planting strips should be provided adjacent to all property lines where a street right-of--way is located adjacent to the parking area. All planting materials used for landscaping must be compatible with the local climate and the soils, drainage and water conditions of the site. The planting materials should consist of native, drought-resistant varieties. Landscaping shall be installed within the next growing season following completion of each building. 0. Maintenance. All Planning Parcels must be maintained in a clean and litter free condition. Noxious weeds must be controlled and eliminated by each property owner. All buildings or other exterior improvements constructed or altered with the PUD shall be subject to the approval of the owner of the school parcel as being in conformance with the Vail Christian High School Design Guidelines. 3 Vail Christian High School PUD All land surface disturbed by construction or erosion must be satisfactorily revegetated and where applicable. Dead or down vegetation which may contribute to wildfire hazard must be eliminated by the property owner, including common owners. Building height shall be defined pursuant to the Eagle County Land Use Regulations, Section 2.05.12. 0. Minimum setbacks for all new structures within the Eagle River Parcel shall be established by: individual Planning Parcels; setbacks sufficient to accommodate utilities, irrigation, drainage, access, and fire code regulations; and structure(s) must be located outside the 100 year floodplain boundary unless approved pursuant to chapter 6 of the ECLUR 0. All exterior non-security lighting shall be turned off at 11:00 p.m. unless for a special event. 0. All development within the VCHS PUD shall meet the Wildlife Proof Refuse Container/Dumpster Enclosure standards of the ECLUR Article 4-410(C ). Section 1.10: Sig_ s. All signs within the VCHS PUD must comply with the provisions of Section 2.11 of the Eagle County Land Use Regulations, unless permitted herein. Permitted Signs. Monument Signs. Location: As generally indicated on the sign plan (Illustration 7). Monument signs shall maintain a 5' setback from the property line. Maximum Size: Monument signs shall not exceed 6 feet in height and 10 feet in width. Features: Constructed as a stand-alone structure with materials to match the building architecture. Lighting: Externally illuminated or shielded down light placed in sign structure. 4 Vail Christian High School PUD Identification Signs. Location: At the areas between each building and access roadway/driveway and at internal intersections or attached to building(s). The building on Lot 3 shall be allowed one sign on each face of the building that has street frontage. Maximum Size: As indicated on sign plan (Illustration 7). Features: Constructed as a stand-alone structure with materials to match architecture. Lighting: Externally illuminated or shielded down light placed in structure. Commercial tenant signage Each individual commercial tenant within Lot 3 shall be allowed a 20 square foot sign. Internally illuminated "canned" signs shall not be allowed. A directory sign identifying the individual businesses within the building. The directory sign shall not exceed 40 square feet in area or 10 feet in height. Window signs may not exceed 25% of the exterior window area of any one commercial entity. A comprehensive sign program for the building on Lot 3 must be developed and reviewed in accordance with the building permit application. Other Signage Including Directional and Trail Signage Location: Throughout site as required for life-safety, direction, usage and for boundary delineation. Maximum Size: 16 square feet or as is required by code. Features: Colors and style to be consistent throughout each individual site. 5 Vail Christian High School PUD Construction Sign Each lot shall be allowed one construction sign not to exceed 32 square feet in area. The construction sign may include the name of the building, a graphic representation of the building and a list of involved entities. Electronic Message Sign An Electronic Message sign maybe allowed in the location of sign 2 as indicated on Illustration 7, Signage Plan. This sign may not exceed 36 square feet of display area and will not exceed 7 feet in height. Section 2.0: Planning Parcel A. Section 2.01: Intent: The Planning Parcel A boundary describes the area in which the various transportation corridors are located. This includes Tracts B, C, D, F, G, K and L. Section 2.02: Permitted Uses. All existing improvements. Transportation Corridor -including but not limited to roadway, railroad(s), sidewalks, pathways, bus stops, parking areas, acceleration and deceleration lanes, signalization, signage and other related improvements. Utility and irrigation distribution lines, facilities, ditches, diversions, water storage, treatment, structures, fencing, enclosures, and other related improvements. Recreational Uses -Trails for hiking, biking, nature study, and other related uses. Open space. Greenbelt. Reclamation. Facilities and activities conducted in support of wildlife management and habitat enhancement 6 Vail Christian High School PUD Section 2.03 Section 3.0: Development Standards. All existing improvements may remain, be maintained, replaced and/or repaired. All new building structures must be located outside the 100 year floodplain unless approved pursuant to Chapter 6 of the ECLUR. Planning Parcel B - Commercial/Religious Site Section 3.01: Intent: The Planning Parcel B boundary describes the area in which the proposed commercial site is located, defined on the Preliminary Plan as Lot 3. Section 3.02: Permitted Uses: Commercial -including but not limited to office, retail, storage and parking garage. Religious uses including up to a 300 seat church and community outreach uses. Government offices and facilities. Educational and school uses. Temporary uses relating to construction activity (i.e. job trailer). Utility and irrigation distribution lines, facilities, fencing, enclosures, and other related improvements. The pre-existing contractors storage yard use of the site may be maintained until a building permit for Lot 3 is issued. At that time contractors storage yard will no longer be a permitted use on Lot 3. Section 3.03: Special Uses. County Special Use Permit. Restaurant Vail Christian High School PUD These uses will require issuance of an Eagle 7 Section 3.04: Development Standards. All new building structures must be located outside the 100 year floodplain unless approved pursuant to Chapter 6 of the ECLUR. Paving, landscaping and drainage improvements maybe located within the 50 foot Eagle River setback. If, at the time of building permit the proposed use is commercial in nature then a payment in lieu of housing in accordance with the linkage section of the Eagle County Local Resident Housing Guidelines as adopted February 11, 2004 shall be required. The aggregate of uses may not exceed 20,000 square feet of building floor area. The Planning Parcel C boundary describes the area of the school /chapel site and includes Lots 1 and 2. Section 4.02: Permitted Uses. High School and related uses. Ancillary related uses, including but not limited to office, maintenance and mechanical uses, cultural, recreation and sports events typically associated with high school use. Utility and irrigation distribution lines, facilities, ditches, diversions, water storage, treatment, structures, fencing, enclosures, and other related improvements. Recreational Uses -typically associated with high school use. Common areas. Open space and trails. Greenbelt. Reclamation. Section 4.03: Development Standards. All new building structures must be located outside the 100 year floodplain unless approved pursuant to Chapter 6 of the ECLUR. Some recreational uses shall also be permitted within the 100 year floodplain. Paving, trails, walkways, landscaping and drainage improvements shall be allowed within the 50 foot Eagle River setback. Roof overhangs and stairways shall be allowed to encroach 7' into any required setback. The aggregate of uses may not exceed 92,500 square feet of building floor area.
