LOWE; H. CHARLES SLATER AND DENISON S. LEVY TO EAGLE COUNTY, COLORADO FOR SLATER MINOR TYPE A SUBDIVISION File No. SMA-00020 WHEREAS, on August 19, 2003, the Board of County Commissioners of the County of Eagle, State of Colorado ("Board") entered into a Subdivision and Off-Site Improvements Agreement with H. Charles Slater (Subdivider) as a condition of approval of the Final Plat of the Slater Type A Minor Subdivision; and WHEREAS, as a condition of approval of the Final Plat of Slater Type A Minor Subdivision the subdivider was required to provide collateral in the total amount of $27,770.00; and WHEREAS, Brian M. Lowe provided collateral in the form of an Assignment of Certificate of Deposit No. 6008504 issued by WestStar Bank in the amount of $10,000.00; and WHEREAS, H. Charles Slater provided collateral in the form of Assignment of Certificate of Deposit No. 6008604 issued by WestStar Bank in the amount of $9,700.00; and WHEREAS, Denison S. Levy provided collateral in the form of Assignment of Certificate of Deposit No. 6008704 issued by WestStar Bank in the amount of $8,000.00; and WHEREAS, by Eagle County Consent No. 2004-11 the County Authorized a first Partial Release of Collateral and Commencement of the two-year Warranty Period; and WHEREAS, by Eagle County Consent No. 2004-12 the Subdivider substituted cash collateral in the amount $2,777.00 which represents 10% collateral to be held for the duration of the two-year warranty period; and WHEREAS, the release of the Assignments of Certificate of Deposit requires termination of the Assignments by written Resolution of the Board of County Commissioners; NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO: THAT, the Board hereby authorizes the release of the collateral and the Assignments of Certificate of Deposit No. 6008504, 6008604 and 6008704 be terminated and that the same be returned to Brian M. Lowe, H. Charles Slater and Denison S. Levy.
