BOARD OF COUNTY COMMISSIONERS
COUNTY OF EAGLE, STATE OF COLORADO
RESOLUTION N0.2004 - Q~
RESOLUTION APPROVING AND RATIFYING THE FILING OF STATEMENTS OF
OPPOSITION IN WATER COURT CASE 03 CW 292 FILING BY EAGLE PARK
RESERVOIR COMPANY, AND IN CASE 03 CW 311 CONCERNING BUCHHOLZ
CHANGE OF RIGHTS AND CASE 03 CW 314 CONCERNING COLORADO SPRINGS
EXCHANGES.
WHEREAS, Eagle County, Colorado ("County") is a political subdivision of the State of
Colorado duly organized and existing pursuant to the laws and the Constitution of the State; and
WHEREAS, the County presently owns certain water rights throughout Eagle County;
and
WHEREAS, those rights could be affected by water court applications filed in case
numbers 03 CW 292, 03 CW 311 and 03 CW 314; and
WHEREAS, the Board of County Commissioners wishes to monitor, preserve and
protect Eagle County's water rights by authorizing and ratifying the filing of statements of
opposition in water court case numbers 03 CW 292, 03 CW 311 and 03 CW 314.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO:
THAT, the Board hereby approves and ratifies in all respects the filing of statements of
opposition in water court case numbers 03 CW 292, 03 CW 311 and 03 CW 314; and
THAT, the Board hereby finds, determines and declares that this Resolution is necessary
for the public health, safety and welfare of the residents of the County of Eagle, State of
Colorado.
