RESOLUTION NO. 98- 15
IN THE MATTER OF ADOPTING A NEW
SUBDIVISION FEE SCHEDULE
APPLICABLE TO
APPLICATIONS PURSUANT TO CHAPTER II
OF THE EAGLE COUNTY LAND USE REGULATIONS
WHEREAS, the Board of County Commissioners of Eagle, State of
Colorado (hereinafter the "Board "), is authorized, pursuant to
State enabling legislation including, but not limited to,
C.R.S. §30 -28 -101, sea., and §30 -11 -101, at sea., to plan for
and regulate the use and development of land in the unincorporated
territory of the County of Eagle, State of Colorado, for the
purpose of promoting the health, safety, convenience, order,
prosperity, and welfare of the present and future inhabitants of
the County of Eagle; and
WHEREAS, pursuant thereto, and pursuant to the provisions of
§ §30 -28 -116 and 133, the Board has adopted zoning and subdivision
regulations; and
WHEREAS, by Resolution No. 98 -147 the Board has adopted new
zoning and subdivision regulations constituting Chapter II of the
Eagle County Land Use Regulations, to be effective January 1, 1999;
and
WHEREAS, pursuant to the provisions of Section 5 -210.B of
newly adopted Chapter TI of the L.U.R., the Board shall adopt a fee
schedule for applications governed by that chapter; and

WHEREAS, the Board desires to adopt a new fee schedule for
zoning and subdivision processes governed by the new Chapter II, to
become effective simultaneously therewith, on January 1, 1999; and
WHEREAS, it is the Board's opinion that conditions require
this action.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO:
THAT, pursuant to the authority granted to it by law and
Section 5 -210.B of the new Chapter II of the Eagle County Land Use
Regulations of the L.U.R., the Board of County Commissioners adopts
the Chapter II, Fee Schedule, of the Eagle County Land Use
Regulations attached hereto, effective on January 1, 1999.
THAT, this Resolution is necessary for the public health,
safety, and welfare of the County of Eagle, State of Colorado.
THAT, this Resolution shall be recorded in the records of the
Eagle County Clerk and Recorder.
MOVED, READ AND ADOPTED by the Board of County Commissioners
of the County of Eagle, Stat� of Colorado, at its regular meeting

J. The following fees awe also applicable:
1. Review fees charged by a state or federal agency shall
be made payable to the reviewing agency based on
current rates and paid at the time of application.
2. For Final Plats, the applicant will be responsible for
paying any plat check fees that are in excess of 25% of
the Final Plat application fees. This additional fee
must be paid prior to the signing of the Final Plat.
3. For the recording of the Final Plat, a filing fee (made
payable to the Eagle County Clerk & Recorder) based on
current recording rates for the plat and for any other
documents recorded is required.
4. For all applications requiring legal descriptions to be
published in the newspaper, additional fees will be
charged on a per cost basis for legal descriptions
which are in excess of $50.00.
If, at the applicant's request for postponement,
readvertisement is required, the entire republication
fee shall be paid by the applicant.
5. When a Special Use Permit application accompanies a
Sketch Plan or Zone District submittal, the Special Use
application fee shall be required unless waived by the
Board of County Commissioners.
Application fees shall be payable by cash or check, made to
the order of the EAGLE COUNTY TREASURER, and shall be
submited with the application to the Community Development
Depal ment. Recording fees for the Final Plat are to be
paid prior to the recording of the Final Plat, by submitting
a check, made to the order of the CLERK & RECORDER.
