HomeMy WebLinkAboutR98-067 Term Limits Ballot Question • • Commissioner 6/1 moved adoption of the following Resolution: BOARD OF COUNTY COMMISSIONERS COUNTY OF EAGLE, STATE OF COLORADO RESOLUTION NO. 98- 6 A RESOLUTION PROVIDING FOR THE SUBMISSION TO THE REGISTERED QUALIFIED ELECTORS OF EAGLE COUNTY, COLORADO, OF A QUESTION WHICH WOULD ELIMINATE TERM LIMITATIONS FOR THE ELECTED OFFICIALS OF EAGLE COUNTY IMPOSED IN ACCORDANCE WITH ARTICLE XVIII, SECTION 11 OF THE CONSTITUTION OF THE STATE OF COLORADO; SAID QUESTION TO BE SUBMITTED AT THE ELECTION TO BE HELD NOVEMBER 3,1998; PRESCRIBING THE FORM OF BALLOT QUESTION FOR SUBMISSION AT SAID ELECTION; PROVIDING FOR CERTIFICATION OF THE ELECTION QUESTION TO THE COUNTY CLERK AND RECORDER; AND OTHERWISE PROVIDING FOR THE CONDUCT THEREOF. WHEREAS, Article XVIII, Section 11 of the Constitution of the State of Colorado provides that no elected officials of any county of the State of Colorado shall serve more than two consecutive terms in office; and WHEREAS, Article XVIII, Section 11 of the Constitution of the State of Colorado further provides that the voters of the County may eliminate the limitations on terms of office imposed by this Section 11; and WHEREAS, the Board of County Commissioners finds that it is in the best interest of the County to request the electors, voting in the next General Election, to consider the elimination of term limits for the elected officials of Eagle County, which elected officials include the Clerk and Recorder, Assessor, Treasurer, Coroner, Surveyor, Sheriff and Commissioner; and WHEREAS, the proposal for the elimination of term limits for elected officials of Eagle County may be submitted at the election to be held on November 3, 1998; and WHEREAS, this election shall be conducted by the Eagle County Clerk and Recorder in accordance with the "Uniform Election Code of 1992 ", Articles 1 to 13 of Title 1, C.R.S. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO: Section 1. CertificatioriOuestion to Clerk and Recorder fo>ection. The following question shall be presented at the election to be held on Tuesday, November 3, 1998. That said election shall be held in accord with the provisions of Colorado State Statute. Section 2. Form of Ballot Question. At the Election there shall be submitted to a vote of the registered qualified electors of the County the following question: Question Shall the limitation of the terms of office provided for in Article XVIII, Section 11 of the Constitution of the State of Colorado for the elected officials of Eagle County (Commissioner, Sheriff, Treasurer, Assessor, Clerk and Recorder, Surveyor and Coroner) be eliminated. YES NO Section 3. Setting the Title. Pursuant to the provisions of §1 -5- 203(3) C.R.S., the County Clerk and the Board of County Commissioners sitting as the title board shall set the ballot title of this measure by resolution prior to September 9, 1998. Section 4. Severability. If any part, section, paragraph, clause or provision of this Resolution shall be adjudged to be invalid or unenforceable, the invalidity or unenforceability of such section, paragraph, clause, or provision shall not affect the remaining sections, paragraphs, clauses or provisions of this Resolution, it being the intention that the various parts hereof are severable. • • MOVED, READ AND ADOPTED by the Bo d of County Commiss'oners of the County of Eagle, State of Colorado, at its regular meeting held the day of , 1998.
