HomeMy WebLinkAboutR98-066 Arrowhead PUD Amendment Approval Commissioner ■zy,79 moved adoption At' of the following Resolution: RESOLUTION OF THE COUNTY OF EAGLE, STATE OF COLORADO RESOLUTION NO. 9 APPROVAL OF AMENDMENT OF THE ARROWHEAD PLANNED UNIT DEVELOPMENT FILE NO. PDA -00007 WHEREAS, on or about March 12, 1998, the County of Eagle, State of Colorado, accepted for filing an application submitted by Vail /Arrowhead, Inc. (hereinafter "Applicant ") for amendment of the Arrowhead Planned Unit Development, Eagle County , Colorado (hereinafter the "PUD "), File No. PDA -00007 ; and WHEREAS, the Applicant requested the amendment of the PUD for the purposes of amending the PUD guide as it pertains to Lower Bachelor Gulch Village, with requested amendments outlined in letters submitted by applicant dated February 6, April 3, and April 17, 1998 ('Exhibit A') ; and WHEREAS, notice of the proposed amendment was mailed to all owners of property located within and adjacent to the PUD and was duly published in a newspaper of general circulation throughout the County concerning the subject matter of the application and setting forth the dates and times of hearings for consideration of the application by the Planning Commission and the Board of County Commissioners of County of Eagle, State of Colorado (hereinafter the "Board "); and WHEREAS, at its public meeting held April 15, 1998 , the Planning Commission, based upon its findings, recommended approval of the proposed PUD Amendment; and WHEREAS, at its p is meeting hearing of Ap 27, 1998 , the Board considered the PUD Amendment application, associated plans and the statements and concerns of the Applicant and the Eagle County staff. Based on the evidence, testimony, exhibits, review of the Eagle County Master Plan, the recommendation of the Planning Commission and staff, and comments from all interested parties, the Board finds as follows: 1. The proposed amendment to the Arrowhead Planned Unit Development is consistent with the efficient development and preservation of the entire PUD. 2. The proposed amendment does not affect in a substantially adverse manner either the enjoyment of the land abutting upon or across the street from the PUD or the public interest. 3. The proposed amendment shall not solely confer a special benefit upon any person. Pursuant to Section 2.06.13(7)(a) of the Eagle County Land Use Regulations (PUD Preliminary Plan): The Planning Commission and County Commissioners shall consider the following in their review of the Preliminary Plan: (1) Adequacy of Final Environmental Impact Statement (if required); (2) Any information requested or required by the County Commissioners upon approving the Sketch Plan; (3) Application for appropriate zone change; (4) The PUD control document. This document formally establishes the permitted land uses and must be filed with the Clerk and Recorder. Pursuant to Section 2.18.02(3) of the Eagle County Land Use Regulations (Subdivision Preliminary Plan): The Planning Commission and County Commissioners shall consider the following in their review of a Preliminary Plan: a) Conformance to the Sketch Plan and any information requested or required by the County Commissioners upon approving the Sketch Plan. b) Review of the Preliminary Plan to determine whether the proposed subdivision conforms to these and other 2 applica e regulations, policies a• guidelines. c) Review of reports on file and others as available pertaining to geologic, soils, wildfire, flood and airport hazards, mineral resource areas and significant wildlife areas and shall consider the guidelines and recommendations as prepared by the appropriate agency, to mitigate hazards and to protect resources. Pursuant to Section 2.06.13(11)(b) of the Eagle County Land Use Regulations (Amendments to PUD): b) In presenting any application for substantial modification, removal or release of the provisions of a PUD plan, the applicant has the burden of proof to establish the following and the Planning Commission and Board of County Commissioners shall consider the following criteria in their review: 1) That proposed amendment is consistent with the efficient development and preservation of the entire PUD; and 2) That the proposed amendment does not affect in a substantially adverse manner either the enjoyment of the land abutting upon or across the street from the PUD or the public interest; and 3) That the proposed amendment is not granted solely to confer a special benefit on any person. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO: THAT, the application submitted by Vail /Arrowhead, Inc. for amendment of the Arrowhead Planned Unit Development be and is hereby granted subject to the following conditions(incorporated in adopted PUD guide, attached as `Exhibit B') . 3 . 1. Parking requirements will be amended in Lower Ba lor Gulch Village for "Multiple Family /Cluster Home" and "Mountain Lodge Tracts" as follows: - 1 parking space required for all studios and single bedroom units. - 1.5 parking spaces required for all multi - family dwelling units less than 3,000 square feet in floor area. 2 parking spaces required for all multi - family dwelling units over 3,000 square feet in floor area. The Board finds, determines, and declares that this Resolution is necessary for the health, safety, and welfare of the inhabitants of the County of Eagle, State of Colorado.
