COUNTY OF EAGLE, STATE OF COLORADO
RESOLUTION NO. 99 - - le, - 3
FINAL RELEASE OF COLLATERAL
AND
TERMINATION OF THE WARRANTY PERIOD
FOR
SNOWBIRD ASSOCIATES
WHEREAS, on or about June 23, 1997, pursuant to C.R.S. X30 -28-
137, the Board of County Commissioners of the County of Eagle,
State of Colorado (Board) granted Road Cut Permit #2408 (Permit)
to Snowbird Associates; and
WHEREAS, in order to guarantee the faithful completion of
certain public improvements required under the Permit, the Board
accepted as collateral an Assignment of Certificate of Deposit No.
26601, Central National Bank and Trust Co. of Enid, in the amount
of $2,000.00; and
WHEREAS, Snowbird Associates, has represented to the Board,
and members of the County staff have corroborated those representa-
tions, that the improvements have satisfactorily survived the two -
year warranty period; and
WHEREAS, Snowbird Associates has applied for a full release of
its collateral;
WHEREAS, based upon the written recommendations of the
Engineering Department, attached hereto as exhibit "A ", the Board
finds that the improvements have satisfactorily survived the two -
year warranty period, and the full release of the Assignment of
Certificate of Deposit No 26601, Central National Bank and Trust
Co. of Enid, in the amount of $2,000.00, is appropriate.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
SSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO:
THAT, the Board hereby authorizes the full and final release
of collateral as said Assignment of Certificate of Deposit No.
26601 in the amount of $2,000,00. and the termination of the
warranty period for Snowbird Associates.
THAT, the Board hereby authorizes Central National Bank and
Trust Co. of Enid to release the security represented by the
Assignment of the Certificate of Deposit Number 26601 to the amount
of $2,000.00.
THAT, this document shall be recorded in the Records of the
Eagle County Clerk and Recorder, which shall be evidence that the
warranty period for Snowbird Associates has been successfully
completed and that the obligations under Road Cut Permit # 2408 are
complete.
THAT, the County will not be accepting maintenance responsi-
bilities for those improvements associated with this Road Cut
Permit.
MOVED, READ AND ADOPTED by the Board of County Commissioners
of the County of Eagle, State of Colorado, at its regular meeting
