That proper publication and public notice was provided as required by law for the hearing before the Planning Commission and the Board of County Commissioners. 2. That pursuant to Eagle County Land Use Regulations Section 1- 150.E.2 the application is subject to review under the land use regulations in effect before January 1, 1999, 3. That all criteria of Section 2.06.13(4) (PUD Sketch Plan Application),Section 2.06.13(5) (PUD Sketch Plan Review), Section 2.06.13(7) (PUD Preliminary Plan Review), Section 2.17.02(3) (Subdivision Sketch Plan Review), Section 2.18.02(3) (Subdivision Preliminary Plan Review), and Section 2.14.04(1) (Zone District Amendment) of the Eagle County Land Use Regulations have been considered. 4. That there is conceptual evidence that the land has access and can be serviced with water and sewage disposal systems appropriate with the zone district being sought. 5. That the land included in the proposed Sketch Plan is suitable for subdivision. 6. That comments and recommendations from the agencies listed in Eagle County Land Use Regulations, Section E 2.17.02(1),.have been considered. 7. That the evidence shows that access which is capable of servicing the development from the state highway system to the parcel of land proposed for subdivision can be built by the Applicant. 8. That an environmental impact statement is not required. 9. That information. required by the Board of County Commissioners at Sketch Plan is applicable. 10. That the proposed PUD control document is satisfactory (see Exhibit A attached). 11.. That an appropriate zone change application has been received. 12. That the proposed Sketch and Preliminary Plan is in conformance with the Master Plan, policies, guidelines, zoning and other applicable regulations. 13. That the area in question possesses the geological, physical and other environmental conditions compatible with the characteristics of the use requested. 14. That the advantages of the use requested outweigh the disadvantages. 15a. That the area for which the rezoning is requested has changed or is changing to such a degree that it is in the public interest to encourage a new use of density in the area; or 15b. That the proposed rezoning is necessary in order to provide land for a demonstrated community need. 16. That for the above stated reasons, the proposed rezoning is in the best interest of the health, safety, convenience, order, prosperity, and welfare of the citizens of Eagle County, Colorado. 3 NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of the County of Eagle, State of Colorado: THAT, subject to the conditions set forth below, the application submitted by Scott Ziegler for approval of a Zone District Amendment and of the combined Sketch and Preliminary Plan for The Ranch House Planned Unit Development - be and is hereby approved for the following described parcel of land: EXHIBIT B THAT, the following conditions are hereby placed upon this approval: 1. The approved site plans shall be reviewed by the Town of Avon Fire Department. Any substantial concerns shall be addressed prior to submission of final plat. 2. Prior to October 1, 1999, Unit 2 (existing garage /apt) shall obtain a Certificate of Occupancy including, but not limited to, final electrical inspection. 3. Prior to the recording of the PUD Guide, the approved Site Plans shall be submitted to the Dept. of Community Development for review. The approved site plans shall include the following revisions: A. Sheet 1 shall be renamed Preliminary Plan, Phase I and Phase.II. B. Landscape Plan shall be renamed Preliminary Plan, Phase III. C. Preliminary Plan, Phase I and II shall remove setbacks in conformance with Preliminary Plan, Phase III. [The approved site plans, attached hereto as Exhibits C, have complied with Condition #3.1 4. Prior to recording of the PUD Guide, the PUD Guide shall be 9 5 submitted to the.Dept. of Community Development for review. This PUD Guide shall include the following revisions: A. The PUD Guide shall include the Phasing Plan. B. The PUD Guide shall reference the approved site plans; Preliminary Plan; Phase I II and Preliminary Plan, Phase III. C. The-PUD Guide shall eliminate Section II (A) regarding setbacks since setbacks have been removed from the plan. D. Section VII. Farm Animals shall include the following statement: Agricultural uses may remain on -site for a period of six (6) years from the date of approval of this PUD Guide or until a building and /or grading permit for the construction of future Unit 6 is issued, whichever shall be first. E. Section IX. (A) Hazardous Materials Storage shall be revised as follows: "Hazardous materials may be stored only within a containment area as described in the Spill Contingency Plan or a minimum of 75 feet from the Eagle River." F. Section IX. (C) Hazardous Materials Storage shall be revised as follows: "The Spill Contingency Plan is attached and shall be considered a part of this document." G. Section IX. (D) Hazardous Materials Storage shall be revised as follows: "The containment area shall be in place prior to the issuance of a building and /or grading permit for any new dwelling unit(s)." H. Section I. (B) l.d (i) shall be removed. I. Section VI. Landscaping shall be revised as follows: 5 A. Per Preliminary Plan - Phase III. B. Existing berms shall be maintained or other suitable screening shall be provided to shield the site from U.S. 6 and the Reserve Bridge Road. Upon submission of the final plat, the applicant shall provide an engineered design for the retaining wall along the southern berm of the property in conformance with Section 2.18.01(4)(o)(2) of the Eagle County Land Use Regulations. 6. Upon submission of the final plat, the applicant shall provide written approval from the Eagle River Water and Sanitation District for the current water provision proposal: 2 existing units on domestic well water and 4 future units on public water supply. otherwise, the Eagle River Water and Sanitation District shall provide potable water for all units. 7. Permanent guard posts or other protective barriers shall be constructed around the fuel storage area for protection from vehicular impact. Said barrier(s) shall be constructed according to current Uniform Fire Code standards and shall be in place prior to the issuance of a building and /or grading permit for any new dwelling unit(s). 8. An erosion control fence in conformance with Eagle County Land Use Regulations shall be erected to contain all current land disturbance as soon as Spring thaw commences (1999). 9. Prior to the commencement of any applicable activity, the applicant shall submit to Eagle County proof of such applicable Federal, State, and Local permits and plans as are required for such activity, including, but not limited to, USACE 404 permits, well and water permits, and grading and building permits. 10. The site plans attached hereto as Exhibits C -1 and C -2 represent the proposed, approved uses and are incorporated G herein by this reference. 11. Except as otherwise expressly modified by this Permit, all material representations of the Applicant in this application and public meeting shall be adhered to and considered conditions of approval unless otherwise amended by other conditions. THAT, the Combined Sketch and Preliminary Plan submitted under this application and hereby approved, does not constitute a "Site Specific Development Plan" as that phrase is defined and used in C.R.S. 24 -68 -101, et seq. Two (2) single - family residences (Unit 1 and Unit 6) and accessory uses customary to single - family residences. Unit 6 cannot be constructed until all agricultural uses are permanently removed. 2. One (1) four -unit (4- unit), multi - family structure located as depicted on the approved site plan (Preliminary Plan -Phase I & II) and shall include the existing apartment over garage and three (3) additional units. 3. Two (2) maintenancelstorage garages to be used for parking of residents' vehicles and from time to time for maintenance and storage of construction and snow removal equipment and vehicles. 4. SECTION II: SETBACKS A. Setbacks from the Eagle River shall be as shown on the Preliminary Site Plans Phases I, If & III. Existing encroachments shall be allowed to remain. B. No development shall be allowed within the 100 -year tloodplain. SECTION III: BUILDING HEIGHTS The maximum building heights shall be as follows: A. North side - facing the Eagle River Forty (40) feet as measured per Eagle County Land Use Regulations - Article 2: Definitions- Building Height calculations for Stepped or Terraced Buildings. B. South side - facing Highway 6 Thirty-five (35) feet as measured per the same regulations. SECTION IV: LOT COVERAGE A. Buildings shall not cover more than 10,000 square feet. B. All impervious materials shall not cover more than 20,000 square feet. SECTION V: FLOOR AREA RATIO Maximum floor area shall not exceed 20,000 square feet. SECTION VI: LANDSCAPING A. Per Preliminary Plan - Phase III B. Existing berms shall be maintained or other suitable screening shall be provided to shield the site from U.S. Highway 6 and from the Reserve Bridge Road. Section VII: FARM ANIMALS A. A maximum of four horses for the total PUD may be kept only if fed from outside Sources and not required to graze. SECTION VIII: SUBDIVISION A. The Ranch House Parcel shall not be subdivided into individual ownerships until and unless the commercial, industrial and agricultural uses are permanently removed. B. Future subdivision shall be reviewed by Eagle County using the Planned Unit Development Amendment Process. SECTION IX: HAZARDOUS MATERIALS STORAGE A. Hazardous materials may be stored only within a containment area as described in the Spill Contingency Plan or a minimum of 75 feet from the Eagle River. B. No more than 800 gallons of hazardous material shall be stored on site at one time. C. The Spill Contingency Plan is attached and shall be considered a part of this document. _ D. Control Guide032499 � SPILL CONTINGENCY PLAN INTRODUCTION Although there are no federal, state or local regulations concerning the location or containment of above ground 500 gallon diesel or gasoline storage tanks, this Spill Contingency Plan was prepared as a voluntary measure to prevent water and ground pollution in case of an accidental Spill. Petroleum Products (stored on site) There are two fuel storage tanks located as shown Exhibit A. Tank No. 1 is a 300 gallon, steel tank that contains diesel fuel. Tank No. 2 is a 500 gallon steel tank that contains diesel fuel. Spill History There has never been a spill at the site. Secondary Containment The containment system for the tanks consists of 14 foot by 14 foot, 12 inch high, lined berm, as shown on Exhibit B attached. The berms will contain 1.4 times the capacity of the two tanks. Surface Swills The following five steps will be taken, in the event of surface spill from either an aboveground petroleum product storage tank or from loading/unloading operations associated with an underground petroleum product storage tank. Step 1 Notify the Emergency coordinator. The Emergency coordinator will assess the human health risks and, if flammable or toxic materials are involved, evacuate the area by activating the fire alarm system. The hazards of responding to releases of materials are identified in the Guidebook for Initial Response to Hazardous Materials Incidents, which will be carried by all ODRT members. When notifying the Emergency Coordinator, give the following information: ♦ Location of spill. ♦ Type of product spilled. ♦ Type and number of personnel involved (public, company). ♦ Estimated quantity of spilled material involved. ♦ Medical assistance needed. Step 2 Cordon off the area with caution tape to keep unauthorized personnel out. Step 3 Initiate containment ♦ Open doors and windows if ignitable materials are spilled in containment areas. This will minimize the buildup of explosive vapors. If the spilled material flows to the Eagle River, notify the following: ♦ Eagle county Environmental Health Division Manager— (970) 328 -8755 ♦ Eagle County Fire Chief— 911 ♦ Colorado Department of Public Health and Environment— (303) 692 -3300 ♦ Sheriff -911 Attempt to obtain information regarding drains connected to the Metro District sewer system. ♦ Appropriate personal protective equipment (PPE) shall be worn at all times during spill containment and cleanup. After securing the impacted area, personnel responding to a spill shall position themselves upwind and out of low -lying areas. In the event the exact nature of the spill is unknown or uncertain, response personnel should cease response activities, evacuate the area, and reevaluate the situation. Appropriate references and.staff resources must be consulted as needed to determine appropriate response actions. If necessary, expert contractors shall be retained to consult or support spill responses. ♦ Attempt to stop the source of the leak by plugging holes in storage tanks or containers, using the shutoff valve(s), or using the over pack drums in the case of leaking barrels. ♦ If the spilled amount is minimal (less than 5 gallons), use absorbent material, vermiculite, etc., to absorb the spill. Use a non - sparking tool such as a plastic shovel or broom and a plastic dust pan to pick up the spent absorbent material and place it into a drum provided for that purpose. Appropriate spill response equipment will be located in an area that is easily accessible at all times, especially during non - operating hours. Do not use rags or other combustible materials to absorb ignitable fluids. Flush the area with soap and water. ♦ If the material is migrating toward the stream or ditch, cover the inlet and, if possible, prevent the material from getting into the drains. Use a plastic tarp to cover a large area, and it anchor to ensure the drain remains sealed. Personnel may use a berm of earthen material or absorbent booms if a plastic tarp is not available. ♦ If a spill occurs within a building with a drain system that exits the building, immediate attempts must be made to block the drain(s) and prevent the escape of spilled materials. Drains shall be blocked using plastic tars, pipe plugs, absorbent booms or other appropriate methods. Put an absorbent boom, a spill sock, or, at a minimum, a pile of absorbent dirt or sand ahead of the down gradient edge to form a pool. This is especially critical if a spill occurs outside or migrates outside of a structure in order to prevent the material from reaching surface water drainage and to minimize infiltration of the spilled material into the ground. Step 4 If the spilled material reaches a waterway, call the Eagle County Sheriff (911) to notify them of a spill, and request long -term cleanup. Notify the National Response Center. (1- 800 - 424 -8802 Step 5 If the spill has reached permeable ground, after as much product has been recovered as possible, the contaminated area should be covered with a plastic tarp in order to prevent precipitation from causing infiltration of the contaminants into the groundwater. The tarp should be anchored with rocks or heavy objects. Cleanup contractors should be called to remove and dispose of contaminated soils if the affected area is too large for personnel to remove. Excavated, contaminated soils must be accumulated in drums or other appropriate containers until they can be properly disposed. Materials generated as a result of spill cleanup activities will be disposed of in accordance with applicable laws and regulations. Notification In the event, of a spill of any size, the following personnel (Table 4 -1) should be notified. Federal regulations require that a written report be submitted to the Regional Administrator of the EPA within 60 days if: ♦ There is spill or discharge of over 1,000 gallons of oil into or upon navigable waters or adjoining shoreline, or ♦ Oil in harmful quantities (as defined in 40 CFR Part 110) is spilled or discharged in two spills within any 12 -month period into or upon navigable waters or adjoining shoreline. Harmful quantities are defined by 40 CFR Part 110 as discharges that violate applicable water quality standards or cause a film or sheen upon discoloration of the surface of the water of adjoining shoreline. Should such an incident occur, the following information, as well as a copy of this SPCC plan will be included in the report submitted to the EPA Regional Administrator. ♦ Name of facility. ♦ Name of owner /operator. ♦ Location. ♦ Date and year of initial facility operation. ♦ Maximum storage or handling capacity of the facility. ♦ Facility description, including maps, flow diagrams, and topographic maps. ♦ The cause of the spill(s), including a failure analysis of the failed system(s). ♦ Corrective actions and/or countermeasures taken including a description of any equipment repairs and/or replacements. ♦ Additional preventive measures taken or contemplated to minimize the possibility of recurrence. ♦ Any additional relevant information as required by the EPA Regional Administrator. If any spilled oil reaches navigable water, it is also required that the NRC will be notified immediately. Cleanu For small spills within the confines of the facility, the ODRT will contain the spill and then implement the following cleanup procedures: 1. Free - flowing fuels will either be recovered using intrinsically safe pumps and tools, or absorbed and removed with absorbent material such as absorbent pellets or pads. After application to surface, the absorbent will be swept or picked up with a spark- resistant shovel. A second application of loose absorbent will be spread over the surface and then swept up with stiff brooms. All contaminated materials will be placed in clean, 55- gallon drums only used for spill response situations. The drums must be labeled using Department of Transportation (DOT) codes. This material will be disposed of by hauling it to an approved disposal site. Z. Oil contaminated soil will be removed and placed in clean, 55- gallon drums stored on -site for spill response and cleanup. The drums will be labeled using DOT codes. The soil will be treated and disposed of in accordance with applicable laws and regulations. SPILL RESPONSE EQUIPMENT The owner should always be equipped with a sufficient supply of cleanup equipment and supplies for spill response activities. A spill control station should be maintained in close proximity to potential spill area. The containment/response equipment and materials to be kept in inventory is identified below. Personnel protective clothing: ♦ Two pairs of safety goggles. ♦ Protective gloves. ♦ Protective coveralls. Equipment: ♦ Absorbent material (loose, granular), booms, pads, and brooms. ♦ Storage drums. ♦ Dry chemical fire extinguisher. ♦ First aid kit. ♦ Explosion -proof flashlight with extra batteries. ♦ Emergency eye wash/shower unit. ♦ Over pack drum with liner and vermiculite. ♦ Non - sparking tools (broom, dustpan, and shovel). ♦ Plugs. ♦ Roll of 6 -mil plastic sheeting. ♦ Tool kit with adjustable wrench, screwdriver, hammer, pry bar, utility knife, and duct tape. PERSONNEL TRAINING In conjunction with the development of the SPCC plan, all facility personnel with petroleum - related responsibilities and activities required, in the event of a spill or release. Hypothetical examples are used to illustrate the chain of command and how to investigate, report, contain, and cleanup spills. Security inspection and prevention requirements are also addressed. New personnel should be trained within their first 4 weeks on the job. Such training will be the responsibility of the owner and will be conducted not only when an employee starts their job, but also on regular basis, through such a means as on- the -job training, regularly scheduled operational/safety meetings, when regulations and/or procedures change, and with annual refresher training.
