HomeMy WebLinkAboutR99-048 rec facility clay shooting for Piney ValleyCommissioner �Ij moved adoption of the following Resolution: BOARD OF COUNTY COMMISSIONERS COUNTY OF EAGLE, STATE OF COLORADO RESOLUTION NO. 99 - 9— Piney Valley Ranches Trust, located within Section 7, T4S, R83W of the 6th P.M., for a Recreational Facility /Sporting Clays Shooting Range in conjunction with the on -going Guiding and Outfitting uses of the subject tract. FILE NO. ZS -00041 WHEREAS,. Piney Valley Ranches Trust (sometimes referred to herein as "Applicant "), filed an application with the Eagle County Department of Community Development on or about June 10, 1998, for a Special Use Permit for a 55 acre site (more or less) owned by the Applicant, as particularly described as SE1 /4, NE1 /4 Section 7 Township 4 South, Range 83 West of the Sixth Principal Meridian, Eagle County,, Colorado, which is incorporated herein by this reference, located in a Resource Zone District in unincorporated Eagle County, to allow (a) uses permitted in the resource zone district regulations and (b) for a Recreational Facility /Sporting Clays Shooting Range in conjunction with the on -going Guiding and Outfitting uses of the subject tract; and WHEREAS, based on the application and the evidence, testimony, exhibits, study of the Master Plan for the unincorporated areas of Eagle County, comments of the Eagle County Department of Community Development, comments of public officials and agencies, the recommendation of the Planning Commission rendered in a public hearing held on September 2, 1998, and comments from all interested parties, the Board of County Commissioners of the County of Eagle, State of Colorado ( "the Board "), finds as follows: 1. Proper publication and public notice was provided as required by. law for the hearings before the Planning Commission and the Board. 2. Pursuant to Section 2.09.01, a) The application conforms to all requirements of the Resource Zone District regulations; 111111111111111111111111111111111111111111111111111111 692633 04/14/1999 06:00P 370 Sara Fisher 1 of S R 0.00 D 0.00 N 0.00 Eagle CO F: \DOCS \SPECIAL \PINEYRAN \APPROVAL.REV b) Utilities adequate to provide water and sanitation service based on accepted engineering standards and approved by the County Environmental Health Officer and the Colorado State Department of Health are either in place or to be constructed in conjunction with the proposed facility; c) Street improvements adequate to accommodate traffic volume generated by the proposed use and to provide safe, convenient access to the use are either in place or to be constructed in conjunction with the proposed use; d) A detailed site plan of the Recreational Facility / Sporting Clays Shooting Range site, drawn to scale showing all physical features and final design and plan were provided; e) Technical reports as necessary to determine the feasibility of the proposed project have been submitted; f) Justification that the proposed special use will not be detrimental to the character of the neighborhood and is consistent with the Master Plan has been submitted; g) An environmental impact report was not required.. 3. The Application complies with the requirements of Section 2.09.03. 4. Pursuant to Section 2.09.04(1), the following have been considered: a) Compatibility of the proposed use with other existing uses in the area; b) Potential effect of the use on the character of the neighborhood; c) Adequacy of access to and from the proposed area; d) Adequacy of water and sanitation service; e) Appropriateness of the physical arrangement of the uses on the proposed site; and f) Consistency with the Eagle County Master Plan and Wolcott Area Community Plan. That for the above - stated and other reasons, the proposed special use is in the best interest of the health, safety, convenience, order, prosperity and welfare of the citizens of Eagle County. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO: THAT, the application of Piney Valley Ranches Trust, File No. ZS- 00041, for a Special Use Permit for a Recreational Facility / Sporting Clays Shooting Range, within the Resource Zone District described herein, be approved with the following conditions: 11 All materials that would be stored on -site, shall be stored within a building or structure. 21 The course should be designed and constructed to meet all applicable safety guidelines of the National Rifle Association, Range Division. 31 The operator of the recreational facility shall provide and maintain portable toilets and potable water on -site. 41 Discharging of firearms shall only be allowed during the time interval of one (1) hour after sunrise and one (1) hour prior to sunset. However, between June 15 and August 30 of each year, discharging of firearms may occur until sunset. 51 The operator of the shooting range shall accommodate reasonable public access to the facility. 61 The following representations contained within the application shall be adopted as conditions of approval: a] The course will be located well within Piney Valley Ranches Trust (PVRT) property boundaries with significant geological and vegetative features on all sides to eliminate possible negative impacts to neighboring landowners or the county populace at large; b] Maximum shot size will be 7.5, and will fall out within 300 yards; C] All target throwers are large- capacity, automated machines, so no personnel will ever be needed in F: \DOCS \SPECIAL \PINEYRAN \APPROVAL.REV 3 trap houses or placed at risk down -range at any time during actual shooting times; d] All targets are biodegradable and are non -toxic to wildlife and domestic livestock; e] Trash receptacles will be placed at the check -in center and all along the course; f] Wads from the shotgun shells shall be gathered at least once annually; 71 All material representations made by the Applicant in the application and public meeting shall be adhered to and considered conditions of approval, unless otherwise amended by other conditions. THAT, the Board of County Commissioners directs the Department of Community Development to provide a copy of this Resolution to the Applicant. THAT, the Board hereby finds, determines and declares that this Resolution is necessary for the health, safety and welfare of the citizens of Eagle County.
