FINAL RELEASE OF COLLATERAL
AND
TERMINATION OF THE SUBDIVISION IMPROVEMI
FOR
EAGLE DAKOTA SUBDIVISION

AGREEMENT
WHEREAS, pursuant to C.R.S. X30 -28 -137, the Board of County
Commissioners of the County of Eagle, State of Colorado ( "County ")
entered into a Subdivision Improvements Agreement dated July 18,
1995 ( "Agreement ") with Dakota Partnership, A Colorado Limited
Liability Company ("Subdivider") as a condition of the County's
final plat approval for Eagle Dakota Subdivision; and
WHEREAS, by Eagle County Consent No. 97 -03, the County
commenced the warranty period for Eagle Dakota Subdivision, said
warranty period to expire March 18, 1999; , and
WHEREAS, both the Subdivider and the Engineering Department
state that the work required under the Agreement is complete and
acceptable and the Engineering Department recommends full release
of the collateral and the termination of the Subdivision Improve -
ments Agreement, see Exhibit "A ", attached hereto and incorporated
herein by this reference. Based upon the oral and written recommen-
dations of the County staff, THE BOARD FINDS that the Subdivider's
obligations under the Agreement have been satisfied.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO:
THAT, the Board hereby authorizes the full and final release
of collateral and the termination of the Subdivision Improvements
Agreement for Eagle Dakota Subdivision.
THAT, the Letter of Credit No. 9110615 issued by First Bank of
Colorado in the amount of $17,539.00, which represents ten percent
(10 %) of the original cost estimate, be terminated.
THAT, Eagle County Road & Bridge is not bound to maintenance
of the Eagle County portion of this subdivision.
THAT, this document shall be recorded in the Records of the
Eagle County Clerk and Recorder, which shall be evidence that the
termination of the SIA for Eagle Dakota Subdivision has been
successfully completed and that the Subdivider's obligations under
the Agreement are complete.

RE: Final Release, Collateral; Termination of SIA
Eagle /Dakota Subdivision now known as Dakota Subdivision
Inspection of the subdivision known as Eagle /Dakota, originally,
has been inspected and performance of all subdivision improvements
were noted to be acceptable. Roadways, curbs and gutters, signage
and drainages were inspected by our office and are in conformance
with applicable standards. Release of collateral (Letter Of Credit
No.9110615 representing 10% retainage for the warranty period) and
termination of the SIA is recommended. No additional warranty
periods are required.
