RESOLUTION NO. 99 - 36
In Re VISTA HI DRIVE
Acceptance of Road for Maintenance
WHEREAS, pursuant to C.R.S. 30- 28 -37, the Board of County
Commissioners of the County of Eagle, State of Colorado ( "Board ")
entered into a Subdivision Improvements Agreement dated June 16,
1997, ( "Agreement ") with Mountain Meadows Ranch, a Colorado limited
partnership( "Subdivider "), as a condition of the Board releasing a
Deed of Trust held by the Board as collateral to guarantee the
completion of the public improvements required under the original
Subdivision Improvements Agreement dated July 25, 1979; and
WHEREAS, pursuant to the Agreement and any amendments thereto,
the County would not accept responsibility for the maintenance of
the road until such time as the road was constructed and completed
in accordance with the standards contained in the Eagle County land
Use Regulations; and
WHEREAS, Subdivider has represented to the Board that the
public improvements associated with VISTA HI DRIVE, for a total
distance of .82 miles from where it intersects with Eagle County
Road 5 -13, located within Mountain Meadows Ranch, Filing II have
been completed, and has therefore requested that the County
undertake maintenance of this road; and
WHEREAS, based upon the oral and written recommendations of
the Department of Engineering, see Exhibit " A " attached hereto and
incorporated herein by this reference, THE BOARD FINDS that Vista
Hi Drive has been constructed to the standards contained in the
Eagle County Land Use Regulations and that Vista Hi Drive should be
accepted for county maintenance.

NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO:
THAT, the County will accept maintenance of Vista Hi Drive
from where it intersects with Eagle County Road S -13 to the end of
the Drive, for a distance of .82 miles.
THAT, this Resolution is necessary for the public health,
safety and welfare of the citizenry of the County of Eagle, State
of Colorado.
MOVED, READ AND ADOPTED by the Board of County Commissioners
of the County of Eagle, State of Colorado, at its regular meeting
held the day of March, 1999.

Request for County Maintenance of Vista Hi Drive

Enclosure (1) request that Eagle County accept Vista Hi Drive for maintenance. Vista Hi Drive is
a road in Mountain Meadows Ranch, Filing No. 2. The Final Plat for Mountain Meadows Ranch
was accepted by the County Commissioners of Eagle County on July 25, 1979. The Final Plat
indicates that the Board of County Commissioners is not obligated to maintain the streets dedicated
to the public until the improvements are completed to the satisfaction of the Board of County
Commissioners.
Vista Hi Drive was constructed to county standards as verified by a joint field inspection on
September 9. 1997 by Brad Higgins, Assistant Road & Bridge Director, and George Roussos,
County Engineer. The Board of County Commissioners, at a meeting on June 16, 1997 approved
the release of collateral associated with Vista Hi Drive under a Subdivision Improvements
Agreement for Mountain Meadows Ranch, Filing No. 2.
The lots surrounding Vista Hi Drive are currently unimproved and have an assessed valuation of
$24,840. The current mill levy for the Road & Bridge Department, when applied to the
aforementioned assessed valuation, generates $62.10 for road maintenance purposes. Brad Higgins
indicated that the road can be maintained with minimal impact on current operations in the Missouri
Heights area. The annual cost for maintenance is estimated at $3,000.
It is our joint recommendation that Vista Hi Drive be accepted for maintenance by Eagle County.
