HomeMy WebLinkAboutR99-031 IGA with eagle county recreation authority and school districtCommissioner moved adoption of the following esolution: BOARD OF COUNTY COMMISSIONERS COUNTY OF EAGLE, STATE OF COLORADO RESOLUTION NO. 99 - A RESOLUTION APPROVING A PROPOSED INTERGOVERNMENTAL AGREEMENT BETWEEN THE EAGLE COUNTY RECREATION AUTHORITY AND THE SCHOOL DISTRICT WHEREAS, the Eagle County Recreation Authority has been formed by an intergovernmental agreement of a number of local entities including Eagle County; and WHEREAS, representatives of the Eagle County Recreation Authority have negotiated an agreement with representatives of the Eagle County RE50J School District (hereinafter the "IGA ") which agreement deals with an exchange of property and use of property; and WHEREAS, the Board of the Eagle County Recreation Authority has referred the proposed IGA to the governing bodies of the respective member entities; and WHEREAS, the property which is the subject of the IGA is within the unincorporated portion of Eagle County and subject to the regulatory authority of Eagle County as it relates to zoning and location and extent review; and WHEREAS, Eagle County has reviewed the proposed IGA and wishes to indicate its approval subject to certain understandings and reservations of the IGA so as to grant due process and all other rights granted by the law to all parties. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF EAGLE COUNTY, COLORADO, THAT: THAT the proposed Intergovernmental Agreement be approved and that the representatives of Eagle County on the Board of the Eagle County Recreation Authority are authorized to vote for the approval of the Intergovernmental Agreement if: 1. A provision is added to the IGA clarifying that the agreement is not intended to create a multiple fiscal year obligation, and any financial obligations created by the Agreement are subject to annual appropriation. 2. That it is in full understanding by the RE50J school District as well as all members of the Eagle County Recreation Authority that this approval does not alter nor effect any regulatory authority of the County. And all land use, "location and extent" or other approvals required by law will still need to be obtained, and will be judged using the requirements of the law without regard to the County's approval. 3. The Board finds, determines and declares that this Resolution is necessary for the public health, safety and welfare of the citizens of the County of Eagle, State of Colorado.
