BOARD OF COUNTY COMMISSIONERS
COUNTY OF EAGLE, STATE OF COLORADO
RESOLUTION NO. 99 -�
A RESOLUTION NOTIFYING THE STATE TREASURER TO
DISTRIBUTE FEDERAL MINERAL LEASING FUNDS IN
ACCORD WITH THE PROVISIONS OF § 34 -63 -102, C.R.S.
WHEREAS, Section 34 -63 -102 of the Colorado Revised Statutes
provides for a distribution of a portion of those moneys received
by the State Treasurer pursuant to the provisions of the Federal
Mineral Lands Leasing Act of February 25, 1920, for the use of
public schools and political subdivisions of the State of Colorado
for the planning, construction, and maintenance public facilities
and for public services; and
WHEREAS, 34- 63- 102(3)(c), C.R.S., provides that each county
shall notify the State Treasurer to have at least twenty -five
percent (250) of the money described in 34- 63- 102(3) (a) distributed
to any school district within the county specified; and
WHEREAS, the aforesaid statute further provides each county
shall also notify the State Treasurer to distribute thirty -seven
and one -half percent (37.5 %) of the moneys described in 34-63 -
102(3)(a) which exceed Two Hundred Fifty Thousand Dollars
($250,000.00) to the municipalities within the county according to
that percentage which the population within each municipality bears
to the total population of all municipalities located within the
county.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO:
THAT, the State Treasurer is hereby directed to distribute a
total of twenty -five percent (25 %) of moneys described in 34-63 -
102(3)(a), C.R.S., to the school districts within Eagle County.
THAT, the twenty -five percent (25a) allocated to the public
school districts within the county shall be divided in proportion
to which the average daily pupil attendance of each district during
the preceding school year bears to the aggregate average daily
pupil attendance in all districts in Eagle County during said
school year. The aggregate average daily pupil attendance in Eagle
County for the school year 1997 -1998 is 5,067.50 pupils. The aver-
age pupil attendance of each school district within Eagle County,
and the resulting percentages, are as follows:

The Board further requests, in accord with Section 34 -63 -102
of the Colorado Revised Statutes, that the State Treasurer disburse
the remaining seventy -five percent (750) to the Treasurer of Eagle
County. In the event the moneys described in 34- 63- 102(3)(c),
C.R.S., exceed Two Hundred Fifty Thousand Dollars ($250,000.00),
the State Treasurer shall distribute to the municipalities within
Eagle County thirty -seven and one -half percent (37.50) of said
moneys according to the percentage which the population within each
municipality bears to the total population of all municipalities
located within Eagle County.
IT IS FURTHER RESOLVED that the office of the County
Administrator is directed to mail a copy of this Resolution to the
State Treasurer as Eagle County's notification and direction as to
disbursement of said mineral leasing funds.
