RESOLIITION N0. 99 -
RESOLIITION CONCERNING
DESIGNATION OF OFFICIAL LEGAL NEWSPAPER
WHEREAS, the Board of County Commissioners of the County of
Eagle, State of Colorado (hereinafter "the Board") is required by
§ 39-11-105 C.R.S. to select a newspaper of general circulation
in which the Treasurer shall publish the delinquent tax list of
the County; and
WHEREAS, the•Board•wishes to designate an official legal
newspaper•of the County of Eagle, State of Colorado, for the
publication of required legal notices; and
WHEREAS, having reviewed the proposals submitted to the
County, the Board determines that the proposal submitted by The
Eagle Valley Enterprise is the proposal most advantageous to the
County.
NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO:
THAT pursuant to the powers granted the Board by § 39-i1-105
and § 30-i1-107 C.R.S. the Board does hereby designate The Eagle
Valley Enterprise as the official legal newspaper of the County
of Eagle, State of Colorado, until further order of the Board of
County Commissioners.

§ 24-70-103. Requisites of legal newspaper
(1) Any and every legal notice or advertisement shall be published only in a daily, a triweekly, a
semiweekly, or a weekly newspaper of general circulation and printed or published in whole or in part in the
county in which such notice or advertisement is required to be published, except as provided in this section.
The newspaper, if published triweekly, semiweekly, or weekly, shall have been so published in such county,
except as provided in this section, continuously and uninterruptedly during the period of at least fifty-two
consecutive weeks next prior to the first issue thereof containing any such notice or advertisement; and the
newspaper, if published daily, shall have been so published in such county, uninterruptedly and continuously,
during the period of at least six months next prior to the first issue thereof containing any such notice or
advertisement. In the case of a municipality having territory in two counties, each of which counties has one
or more legal newspapers within the municipality, the publication by such municipality of its legal notices
and advertisements in one of such newspapers shall be construed as valid publication under this part 1.
(2) The mere change in the name of any newspaper or the removal of the principal business office or seat
of publication of any newspaper from one place to another in the same county shall not break or affect the
continuity in the publication of any such newspaper if the same is in fact continuously and uninterruptedly
printed or published within such county. A newspaper shall not lose its rights as a legal publication if it fails
to publish one or more of its issues by reason of a strike, transportation embazgo or tie-up, or other casualty
beyond the control of the publishers. Any legal notice which fails of publication for the required number of
insertions by reason of a strike shall not be declared illegal if publication has been made in one issue of the
publication.
(3) If in any county in this state no newspaper has been published for the prescribed period at the time
when any such notice or advertisement is required to be published or if there is no newspaper published
therein, such notice or advertisement may be published in any newspaper printed in whole or in part in an
adjoining county and having a general circulation in whole or in part in said county having no newspaper
published therein.

§ 39-11-105. Selection of newspaper publishing notice
It is the duty of the boazd of county commissioners of each county to select a newspaper of general
circulation published or having general circulation in said county, in which the treasurer shall publish the
delinquent tax list of his county, and for such service the boazd shall allow payment not exceeding the rate as
provided by law.

' To the officials of Eagle County:
' We are again pleased to submit our annual Eagle County Legal Notices bid and
hope to continue our long-term partnership in publishing county legal notices.
At The Enterprise, we continue to expand our operations, including increased
' distribution to Vail, Avon and, for the first time, Beaver Creek. We also
started limited distribution of our Thursday paper to E1 Jebel and Basalt.
We also completed a computer system upgrade and will begin a new Sunday paper,
' which is part of a regional effort. Our parent company has purchased papers in
the Roaring Fork Valley area, which in the past has been a difficult location
for the county to reach with its legal notices. Through The Enterprise, you can
' now arrange for concurrent listings of the legal notices in one of these papers
at substantial savings from dual contracts.
' Finally, we have ordered, and will begin using next year, an advanced optical
scanner for legal notices, a move that will lower costs by reducing space needed
for some filings. Also, we can now reformat most program documents and that
allows us to accept more digital submissions. The recent county bill schedule
' that cost $1,525 at the display rate would have cost only $1,235 if submitted
digitally, a reduction of approximately 20 percent. Most of your departments now
have digital capability, too.
' Whether technology, business acquisitions or communication protocol, we as a
staff take seriously our longstanding commitment to working with you in meeting
the procedural needs and obligations of publishing the county legal notices, and
' to do so in the most efficient and cost-effective manner. With that in mind, we
once again have not raised our rates to you and, in fact, have lowered the
display rates by approximately 10 percent. The latter reduction is in
consideration of the added volume of notices now generated.

' The Enterprise is the only paid-circulation newspaper circulated in Eagle
County. We have almost 90 percent paid circulation, an important determination
in a newspaper's ability to carry legal notices. The Enterprise does not rely on
free distribution to reach residents nor does it target tourists. Our largest
circulation base is also the county's largest year-round population base.
The Enterprise has a long-standing relationship with second-party attorneys who
' place legal notices within the jurisdiction of Eagle County.
The Enterprise has maintained a very low error rate. We take seriously our role
' as a partner in county government and, thereby, in ensuring that the required
notices of meetings and sheriff's and trustee sales occur as planned.
The Enterprise's main office is within minutes of the county and court
' buildings, an asset in meeting publication. deadlines and in amending or proofing
notices. This proximity also provides for efficient delivery of camera-ready
items.

' We will begin using an advanced optical scanner next year, and our computer
upgrade has allowed us to convert and format more programs than ever before.
Because of this, certain legal documents sent to us on disk or that we have
authorization to scan will cost approximately 20 percent less than past charges.
Our parent company has purchased two papers in the Roaring Fork Valley area (The
Roaring Fork Sunday and The Valley Journal). This area of Eagle County has been
' difficult to reach with legal notice publication. We could discuss and arrange
for concurrent listings of legal notices in one of these papers at substantial
savings compared to the cost of individual contracts with two newspapers. Also,
we have a new Sunday paper that has regional sections, and we could discuss
t listings of county legal notices in this publication as well.
EXCEPTIONS
Digital (computer) submissions would eliminate the need for the more expensive
"display" prices and would save the county up to 20 percent (approximate) on
legal notice charges. [The county bill schedule is a prime example. Reformatting
' would reduce spacing in the printed text that we now receive.]
