=(� WHEREAS, on or about September 13 1997, pursuant to C.R.S.
X30 -28 -137, the Board of County Commissioners of the County of
Eagle, State of Colorado (Board) granted Permit # 2468 (Permit) to
Stephanie and Marc Churchill (Churchill); and
WHEREAS, in order to guarantee the faithful completion of
certain public improvements required under the Permit, the Board
accepted as collateral an Assignment of Certificate of Deposit No.
18514 issued by Mountain Bank, in the amount of $1,450.00; and
WHEREAS, Churchill has represented to the Board, and members
of the County staff have corroborated those representations, that
the improvements have satisfactorily survived the two -year warranty
period; and
WHEREAS, Churchill has applied for a full release of their
collateral;
WHEREAS, based upon the recommendations of the Engineering
Department, the Board finds that the improvements have
satisfactorily survived the two -year warranty period,.and the full
release of the Assignment of Certificate of Deposit No. 18514,
Mountain Bank, in the amount of $1,450.00 is appropriate.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO:
THAT, the Board hereby authorizes the full and final release
of collateral as said Assignment of Certificate of Deposit No.
18514, Mountain Bank, in the amount of $1,450.00 and the
termination of the warranty period for Churchill.
THAT, the Board hereby authorizes Mountain Bank to release the
security represented by the Assignment of the Certificate of
Deposit Number 18514, in the amount of $1,450.00.

THAT, this document shall be recorded in the Records of the
Eagle County Clerk and Recorder, which shall be evidence that the
warranty period for Churchill has been successfully completed and
that the obligations under Permit # 2468 are complete.
THAT, the County will not be accepting maintenance
responsibilities for those improvements associated with this
Permit.
MOVED, READ AND ADOPTED by the Board of County Commissioners
of the Count of Eagle, State Colorado, at its regular meeting
