BOARD OF COUNTY COMMISSIONERS
COUNTY OF EAGLE, STATE OF COLORADO
RESOLUTION NO. 99-
RESOLUTION ESTABLISHING A PROPERTY TAX WORK -OFF
PROGRAM FOR SENIORS
WHEREAS, pursuant to Section 39 -3.7 -102, C.R.S., any taxing entity which levies and
collects real property taxes may establish a property tax work -off program in accordance with state
law which allows any taxpayer who is sixty years of age or older to perform work for the taxing
entity in lieu of the payment of any real property taxes, or portion thereof, due and owing on the
homestead of such taxpayer for any given property tax year; and
WHEREAS, the Board of County Commissioners ( "Board ") wishes to provide the
opportunity to Senior residents of Eagle County to "work -off' their real property taxes; and
WHEREAS, the Board will set aside funds in its budget in order to provide funds for
administration and program expenses; and
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO:
THAT, a property tax work program ( "Senior Tax Work Off Program" or "Program ") be
established in Eagle County with the following requirements:
1. Participants must be sixty years or older as of the date on which taxes become due;
2. Participants must be residents of Eagle County;
3. The property on which the property taxes are due and owing must be the homestead
of the participant;
4. The taxpayer making application for the program must, singly or j ointly with another
person residing in the homestead, own the fee simple estate or be purchasing the fee simple estate
under a recorded instrument for sale; except that nonresidence of the joint owner in the homestead
because of ill health of the joint owner shall not prevent the taxpayer from meeting the requirements
of this paragraph (4.);
5. The property on which the property taxes are due and owing is not income - producing.
THAT, Participants in the Program shall be paid the hourly federal minimum
wage, currently $5.35 per hour.
THAT, initially the maximum number of participants in the Program shall be 100.
THAT, initially the maximum number ofhours worked will be 48, for a maximum gross pay
of $256.80.
THAT, the Participants will become temporary employees of Eagle County and will be
placed in positions with Eagle County.
THAT, payment will be made by the County under this Program will be made by check or
warrant issued to the Participant payable only to the Eagle County Treasurer.
THAT, Participants shall be responsible for delivery of the check or checks to the Eagle
County Treasurer in order for such amount to be credited to the property tax which is due and owing
on the homestead of the taxpayer for such property tax year.
THAT, after the initial year of the Program, the Board may increase or decrease the number
of participants and payment made due to changes in the minimum wage or changes in the County
budget through its annual budget process.
THAT, the Eagle County Department of Health and Human Services is directed to prepare
procedures and applications to implement the Program.
THAT, the Department of Health and Human Services shall publicize the Program to the
residents of Eagle County.
THAT, applications for participation in the Senior Tax Work Off Program shall be available
through the Eagle County Human Resources Department.
THAT, the program shall begin on January 1, 2000.
THAT, the Board hereby finds, determines and declares that this Resolution is necessary for
the public health, safety and welfare of the residents of the County of Eagle, State of Colorado.

of Eagle, State of Colorado, at its regular meeting held the 416 day of B
