HomeMy WebLinkAboutR99-156 Rocky Mountain Natural Gs (KN) final releaseCommissioner moved adoption of the following Resolution: BOARD OF COUNTY COMMISSIONERS COUNTY OF EAGLE, STATE OF COLORADO RESOLUTION NO. 99- /610 FINAL RELEASE OF COLLATERAL OF BOND NO. 318257/142185080 AND TERMINATION OF THE RECLAMATION AGREEMENT FOR ROCKY MOUNTAIN NATURAL GAS COMPANY KN ENERGY WHEREAS, on or about May 16, 1995, the Board of County Commissioners of the County of Eagle, State of Colorado (Board) granted to Rocky Mountain Natural Gas Company (Rocky Mountain) a Special Use Permit, ZS- 363 -95, to construct, operate and maintain a 12 -inch pipeline from south of Eagle to the Edwards Exchange Station; and WHEREAS, on or about May 16, 1995, the Board and Rocky Mountain entered into a Reclamation Agreement with regard to the Special Use Permit; and WHEREAS, in order to guarantee the faithful completion of certain public improvements required under the Permit, the Board accepted as collateral Subdividers Completion Bond No. 318257 in the amount of $20,545.00; and WHEREAS, Rocky Mountain has represented to the Board, and members of the County staff have corroborated those representa- tions, that the reclamation work under this permit was completed in 1995. Inspection was completed on July 13, 1999 indicating the reclamation has proven to be successful entering the fourth year since completion; and WHEREAS, Bond No. 318257 would be replaced with 142185080 also in the amount of $20,545.00 if needed; and WHEREAS, Rocky Mountain has applied for a full release of its collateral; WHEREAS, based upon the written recommendations of the Engineering Department, attached hereto as exhibit "A ", the Board finds that the reclamation work under this permit is complete, and the full release of said bond in the amount of $20,545.00, is appropriate. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO: THAT, the Board hereby authorizes the full and final release of collateral, as said Bond in the amount of $20,545.00, and the termination of the Reclamation Agreement for Rocky Mountain National Gas Company. THAT, this document shall be recorded in the Records of the Eagle County Clerk and Recorder, which shall be evidence that the Reclamation Agreement for Rocky Mountain Natural Gas Company has been successfully completed and that the obligations under that Agreement are complete. Johnson, MI r .,„ This Resolution passed by 00 vote of the Board of County Commissioners of the County of Eagle, State of Colorado. nlr\r \rkymtn.rel MEMORANDUM EAGLE COUNTY ENGINEERING TO: Nancy Lewis / Attorney's Office FROM: Mike Gruber / Engineering DATE: July 13, 1999 RE: Special Use Permit, ZS- 363 -95 Rifle -Avon Natural Gas Pipeline, Collateral Release, Bond No. 142185080, and Termination of the attached RECLAMATION AGREEMENT within Resolution 95 -55 Our office received a letter dated June 28, 1999 from KN Energy, Inc. formally requesting inspection and release of the bond for successful completion of the work under the Special Use Permit. The reclamation work under this permit was completed in 1995. Inspection was completed on July 13, 1999 indicating the reclamation has proven to be successful entering the fourth year since completion. Release of the collateral amount of $20,545.00, bond No. 142185080 as requested is recommended. Termination of the Reclamation Agreement incorporated into resolution 95 -55 is also recommended.
