HomeMy WebLinkAboutR99-150 bearcat at the ranch final releaseCommissioner _ moved adoption of the fol6owing Resolution: BOARD OF COUNTY COMMISSIONERS COUNTY OF EAGLE, STATE OF COLORADO .RESOLUTION NO. 99 - 150 AUTHORIZING FINAL RELEASE OF COLLATERAL AND TERMINATION OF THE SUBDIVISION IMPROVEMENTS AGREEMENT FOR CORDILLERA SUBDIVISION, FILING 13 ( Bearcat at the Ranch) WHEREAS, pursuant to C.R.S. 30- 29 -37, the Board of County Commissioners of the County of Eagle, State of Colorado ( "County") entered into a Subdivision Improvements Agreement dated June 25, 1995, with Stag Gulch Partners ( "Subdivider ") as a condition of final plat approval for Bearcat At the Ranch at Cordillera, Phase II, Cordillera Subdivision Filing 13; and WHEREAS, by Eagle County Resolution No. 97 -08, the County commenced the warranty period for Cordillera Filing 13, said warranty period to expire July 1, 1999; and WHEREAS, both the Subdivider and the Engineering Department state that the work required under the Agreement is complete and acceptable and the Engineering Department recommends full release of the collateral and the termination of the Subdivision Improve- ments Agreement, see Exhibit A, attached hereto and incorporated herein by this reference. Based upon the oral and written recommendations of the County staff, THE BOARD FINDS that the subdivider's obligations under the Agreement have been satisfied. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO: THAT, the Board hereby authorizes the full and final release of collateral and the termination of the Subdivision Improvements Agreement for Cordillera Subdivision Filing 13. THAT, Eagle County does not assume responsibility for maintenance or upkeep of the roads in Cordillera Subdivision Filing 13. THAT, collateral in the form of Letter of Credit No. 9382135 in the amount of $15,899.00 be released. THAT, this document shall be recorded in the Records of the Eagle County Clerk and Recorder, which shall be evidence that the termination of the SIA for Cordillera Subdivision Filing 13 has been successfully completed and that the Subdivider's obligations under the Agreement are complete. Johnson, Jr. This Resolution passed by S —0 vote of the Board of County Commissioners of the County of Eagle, State of Colorado. #87 -84 kaw \r \sopris.£in MEMORANDUM EAGLE COUNTY ENGINEERING TO: Nancy Lewis Eagle County Attorney's Office FROM: Helen Migchelbrink Engineering Department DATE: August 16, 1999 RE: Cordillera, Filing 13, Bearcat at the Ranch, Phase II The warranty period for Cordillera Filing 13, Bearcat, Phase II expired on July 1, 1999 (Consent No. 97 -08). In response to a call from Carmen at Continental U.S. Construction, I conducted an inspection of the improvements made to this site on August 13, 1999. The work has successfully sustained the warranty period. It is my recommendation that the full release of collateral in the amount of $15,899.00 be made.
