HomeMy WebLinkAboutR99-143 ratifying extension of comprehensive plan roaring fork railroadCommissione moved adoption of the following Resolution: BOARD OF COUNTY COMMISSIONERS COUNTY OF EAGLE, STATE OF COLORADO RESOLUTION NO. 99 -Zq3 A RESOLUTION RATIFYING THE EXTENSION OF THE COMPREHENSIVE PLAN BEING DEVELOPED BY THE ROARING FORK RAILROAD HOLDING AUTHORITY WHEREAS, on June 26, 1997 Eagle County approved an Amended and Restated Intergovernmental Agreement Between Pitkin County, Eagle County, the City of Glenwood Springs, the City of Aspen, the Town of Carbondale, the Town of Basalt, and the Town of Snowmass Village Concerning the Purchase ands Public ownership of the Aspen Branch of the Denver & Rio Grande Western Railroad Right -of -Way ( hereinafter the "Amended Agreement'); WHEREAS, the Amended Agreement under paragraph 6e requires that a Comprehensive Plan for the Aspen Branch be developed, considered, and approved within twenty -four months of the date of the Amended Agreement; WHEREAS, the work underway to satisfy the condition of the Amended Agreement requiring the development of the Comprehensive Plan has progressed to a point where it is substantially complete, but an additional amount of time will be required to complete the work and have the Comprehensive Plan approved by the Governments; and WHEREAS, the Board of Directors of the Roaring Fork Railroad Holding Authority passed Resolution No. 2 -99 on June 25, 1999 requesting that Eagle County ratify the action of the RFRHA Board extending the target date for the completion of the Comprehensive Plan to October 31, 1999. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO: THAT the Board hereby ratifies the action of the board of Directors of the Roaring Fork Railroad Holding Authority extending the target completion date for the Comprehensive Plan to October 31, 1999; and THAT the Board finds, determines and declares that this Resolution is necessary for the public health, safety and welfare of the citizens of the County of Eagle, State of Colorado.
