RESOLUTION AUTHORIZING THE DIRECTOR AND THE APPOINTED ACTING
DIRECTOR OF THE EAGLE COUNTY
DEPARTMENT OF HEALTH AND HUMAN SERVICES TO
ENTER INTO AND EXECUTE
EAGLE COUNTY CHILD CARE SERVICES FISCAL AGREEMENTS
WHEREAS, the Eagle County Department of Health and Human Services ("ECDHHS")'
does from time to time desire to enter into and execute the following child care services
agreement with various Providers: Eagle County Child Care Services Fiscal Agreement,
attached hereto as Exhibit A and incorporated herein; and
WHEREAS, in the interests of providing timely child care services, the Director and
appointed Acting Director of the ECDHHS seek the authority from the Board of County
Commissioners to enter into and execute these agreements; and
WHEREAS, the Board is desirous of designating the Director and the appointed Acting
Director of the ECDHHS as its authorized representatives to enter into and execute said
agreements.
NOW, THEREFORE, BE TT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO:
THAT, the Board hereby designates the Director and appointed Acting Director of the
Eagle County Department of Health and Human Services as its duly appointed representatives
and agents to execute said agreements in furtherance of the provision of timely child care
services.
THAT, the Board of County Commissioners finds, determines and declares that this
Resolution is necessary for the public health, safety and welfare of the citizens of the County of
Eagle, State of Colorado.

This Agreement is entered into and between Eagle County Health & Human Services, herein referred to as "Department" and
provider, herein referred to as provider. This agreement shall be in effect on
January 1, 2003 and shall be terminated on December 31, 2003.
Provider Agrees to:
1. Provide child care at the facility address listed above. Conform to all applicable State and Federal Regulations and
local law and maintain a valid child caze license as required by Colorado Statute unless legally exempt from
licensing. Cazry adequate liability insurance unless legally exempt from licensing.
2. Provide caze for children under this agreement only when authorized by the Department in advance. Allow parents
immediate access to the child in care unless otherwise restricted by the custodial pazent.
3. Accept referrals for child caze without discrimination with regazd to race, color, national origin, age, sex, religion,
or physical or mental handicap. Maintain as strictly confidential all information concerning children and their
families.
4. Provide children with adequate food, shelter, and rest. Protect children from abuse/neglect and report any
suspected child abuse and neglect to the Department
5. Not allow anyone else to caze for children under this Agreement. In an emergency a licensed Day Care Home
Provider may arrange for someone else to provide child caze. All other changes must have prior county approval.
6. Collect fees from parents in accordance with the amount on the most current Child Care Certificate, and not chazge
pazents rates in excess of the rates in this Agreement. Notify the Department of a parent=s failure to pay the
pazental fee or to make satisfactory azrangements to pay the fee.
7. Notify the Department of excessive absences or irregulaz child caze usage within 3 working days; notify the
Department if a child is no longer in your facility for reasons other than termination by the Department within 1
working day.
8. Bill the Department monthly for services provided in the previous calendaz month on the State prescribed billing
form and forfeit payment for services when the billing form is submitted to the Department more than 60
days following the month of service.
9. Maintain daily attendance records, payment records, and fee collection records for a minimum of five years and
provide access to these records to county, state, federal officials and others as authorized in writing by the county.
10. Hold the Colorado Department of Human Services, the State of Colorado and the Eagle County harmless for any
loss or actions caused by the performance of this Agreement.
Complete the following information on the daily rates you chazge the public. Allowable rates shall not exceed the Eagle
County reimbursement levels. Please indicate the full daily rate for children. Full time caze is 5 to 11 hours. Part-time care
is care under 5 hrs a day and will be reimbursed on an hourly rate based on one-tenth of the daily rate.

Eagle County will not reimburse for transportation, activity or registration fees. Eagle County will reimburse up to three
days absence for. illness of the enrolled child only. Other absences will not be reimbursed. Eagle County will not'
reimburse for Holidays.
Provider Rights:
1. When a provider contends that the county has not made adequate payment based on program rules for care provided,
the provider has the right to an informal conference with county staffpursuant to 9CCR 2503-1 at section 3.911,E
(Effective 8/01/95) Providers may request a conference in writing within 15 days of the date of the action.
> Written request from the provider should be addressed to Kathleen Forinash, Director, Eagle County
Health & Human Services, P.O. Box 660, Eagle, CO 81631.
> Provider may request that state program staff participate in the conference. That participation maybe by
telephone conference.
> The purpose of the conference will be limited to discussion of the payments in dispute and the relevant
rules regarding payment.
2. A provider may request an informal conference if s/he disputes the termination of a fiscal agreement.
Providers may request a conference in writing within 15 days of the dates of the action. Written request from the provider
is to be addressed to Kathleen Forinash, Director, Eagle County Health & Human Services, P.O. Box 660, Eagle, CO
81631. The purpose of the conference will be limited to discussion to termination of agreement pursuant to 9CCR 2503-1
at section 3.905.1.D (Effective 8/01/95).
Department Agrees to:
1. Reimburse the provider for authorized child caze in accordance with Eagle County Child Caze Assistance Plan.
Payment to the provider is the total cost of authorized caze based on rates set by this Agreement minus the parental
fee.
1. Determine client's eligibility for child caze services.
2. Send notices to the provider of changes in parental fees, authorized amount of care, added or deleted children, and
other changes to child care arrangements. Send initial Child Care Certificate to the provider within 7 working days
of County's verbal approval of each child.
3. Provide an informal conference within 2 weeks of the provider's written request to discuss the basis for any denial
or termination of this agreement or to discuss any payment dispute.
This Agreement maybe terminated by either party by giving the other party 30 days notice by registered mail.
This Agreement may be terminated without advance notice if a child's health or safety is endangered or if the
provider is under a negative licensing action. The provider may request an informal conference to discuss the
basis of any termination or denial of this agreement by submitting that request in writing within 15 days of the
action. By signing this agreement, the provider acknowledges receipt of information regarding the rules and
policies of the Eagle County Child Assistance Plan.
