HomeMy WebLinkAboutR03-083 Eagle County Red Table Acres Public Improvement Districti~ di • Commissioner s moved adoption of the following resolution: BOARD OF COUNTY COMMISSIONERS COUNTY OF EAGLE, STATE OF COLORADO RESOLUTION NO. 2003 3 ORDER FIXING HEARING DATE, TIME, AND PLACE TO `CONSIDER CREATING THE "EAGLE COUNTY RED TABLE ACRES PUBLIC IlVIPROVEMENT DISTRICT" WHEREAS, Petitioners' representatives have initiated the organization of a district pursuant to Section 30-20-501 et.seq. C.R.S. known as the "County Public Improvement District Act of 1968" by filing a petition in the office of the Clerk to the Eagle County Board of County Commissioners; and WHEREAS, Section 30-20-507 C.R.S. provides that as soon as possible after the filing of such petition, the Board of County Commissioners shall fix, by order, a place and time, not less than twenty (20) days nor more than forty (40) days after the petition is filed for a hearing thereon; and WHEREAS, said petition was filed on the 26~' day of June, 2003; and WHEREAS, the Clerk to the Eagle County Board of County Commissioners is required to publish notice of said hearing pursuant to Section 30-20-503(4) C.R.S. for three consecutive weeks in a newspaper of general circulation in the district and has commenced such publication; and WHEREAS, pursuant to C.R.S. 1-7-116 a political subdivision that has taken formal action to participate in a general election shall notice the Clerk 100 days before the election. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO: THAT the hearing to consider the creation of the Eagle County Red Table Acres District (hereinafter "District").shall be scheduled for the 29~' day of July, 2003, at 1:30 p.m. in the Eagle County Room, Eagle County Building, 500 Broadway, Eagle, Colorado. THAT the Clerk of the Board of County Commissioners shall and has caused notice by publication to be made of the pendency of the petition, of the purposes and boundaries of the proposed district and the time and place of hearing thereon. ~. w ~ ~ THAT the Clerk of the Boazd of County Commissioners shall and has caused notice to be mailed to each elector of the District at the elector's last known address, as disclosed by the tax records of the counties -and the last official voter registration lists. THAT the Clerk shall~and has also caused a copy of said Notice to be mailed to each municipality located within three (3) miles of the boundaries of the proposed District at the same '~ time notice is mailed to the electors of the district. THAT the Boazd of County Commissioners hereby ratifies any actions taken by the Clerk to publish and provide notice pursuant to C.R.S. 30-20-507 prior to the issuance of this Resolution. THAT the Boazd of County Commissioners by this Resolution and Order hereby directs the County Attorney to advise the Clerk of its intention to pazticipate in the general election, subject to and conditioned upon heazing on the Petition for creation of the Eagle County Red Table Acres Public Improvement District and entry of a resolution adjudicating all questions of jurisdiction and ordering the question of organization and such other matters as the Boazd deems appropriate. In the event that the Boazd dismisses the Petition at the hearing on the Petition, the County Attorney shall advise the Clerk of its intention to not participate in the general election.
