AND SECTION 4700.C., CHAPTER II, OF THE EAGLE COUNTY LAND USE REGULATIONS WHEREAS, the Boazd of County Commissioners. of the County of Eagle, State of Colorado (hereinafter the "Boazd'~, is authorized pursuant to State enabling legislation including, but not limited to, Section 30-28-101, et seq., to plan for and~regulate the use and development of land. in unincorporated territory of the County of Eagle, State of Colorado, for the purpose of promoting the health, safety, convenience, order, prosperity and welfaze of the present and future . inhabitants of the County of Eagle; and, ~ . WHEREAS, the Boazd is authorized pursuant to Section 30-28-133 (4) (a) to require new residential subdivisions to dedicate land for schools or, in lieu thereof, payment of a sum of money not exceeding the fair market value of the sites and land azeas, or a combination of such dedication and such payment; and WHEREAS, the Boazd is authorized pursuant to Section 4-700.C., Chapter II, of the Eagle County Land Use Regulations to require a subdivider of land in each residential subdivision or portion of a subdivision intended for residential use to allocate and convey sites and land azeas for schools; and WHEREAS, the Board is authorized pursuant to Section 4-700.C., Chapter II, of the Eagle County Land Use Regulations to require, in lieu of such conveyance of land, the payment in cash by the subdivider of an amount not to exceed the full market value of such sites and land area for schools; and WHEREAS, the Boazd is directed by Section 4-700.C., Chapter II, of the Eagle County Land Use Regulations to determine and set annually the current full mazket value of unimproved land on a per acre basis; and INVA,N~I~W~~IVI~~W~II~I~M :~'e"~ .. • • . NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY CONIlVIISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO: THAT, the following aze established as the geographic azeas, as depicted in Exhibit "A", labeled as Land Values for Payments of Cash in Lieu of School Land Dedication - 20 May 2003, which is attached hereto and made a part hereof, and values per acre to be used in various formulas to calculate the cash to be paid in lieu of land school dedication pursuant to Section 4- 700.C., Chapter II, of the Eagle County Land Use Regulations: Avon -- Eagle-Vail ~ $150,000 Beaver Creek -- Lake Creek $ 61,000 Camp Hale $ 5,000 Cottonwood Pass $ 22,500 Dotsero $ 28,980 Eagle $ .42,500 Edwazds -Arrowhead $ 59,000 Eastern Frying Pan $ 7,000 Frying Pan $ 38,860 Fulford $ 4,980 General Rural North $ 8,000 Gypsum $ 35,930 Mining Claims $ 2,200 Minturn -Red Cliff $ 38,000 North Eagle $ 30,500 Wolcott -Edwards $ 35,000 Valley Floor -Missouri Heights $ 32,200 THAT, the Boazd determines these values should be used, subject to the provisions of Section 4-700.0., Chapter II, of the Eagle County Land Use Regulations, until a further determination is made by the Boazd. 2 THE BOARD fiu~ther finds, determines and declazes that this Resolution is necessary for the health, safety and welfaze of the inhabitants of the County of Eagle, State of Colorado.
