APPROVAL OF A SITE SPECIFIC DEVELOPMENT PLAN FOR THE
COLORADO MOUNTAIN COLLEGE EAGLE RIVER VALLEY ACADEMIC CENTER
ON ALTERNATIVE USE TRACT A
OF THE BERRY CREEK /MILLER RANCH PLANNED 'UNIT DEVELOPMENT
FILE NO. PR-00021
WHEREAS, on or about 25 November 2002, the County of Eagle, State of Colorado, ,
accepted for filing an application submitted by Colorado Mountain College .{hereinafter
"Applicant") for approval of a Site Specific Development Plan for Alternative Use Tract A of the
Berry Creek/Miller Ranch Planned Unit Development, File No. PR-00021; and,
WHEREAS, the Applicant requested the approval of a Site Specific Development Plan
which would allow for the development as follows:
A two story, 30,525 squaze foot, academic building located on the 16.0 acre Tract A of
the Berry Creek /Miller Ranch PUD, representing the initial phase of development by
Colorado Mountain College on this site. Other proposed site features include 1 ~ 8 pazking .
spaces, a future ECO Transit bus shelter, and landscaping to be installed in phases over
three yeazs.
WHEREAS, notice of the Site Specific Development Plan was given to all proper
agencies and departments as required by the Berry Creek/Miller Ranch PUD Guide and hand
Use Restrictions, dated 13 February 2002; and,
WHEREAS, at its public hearing held 7 May 2003, the Eagle County Planning
Commission, based upon its findings, recommended approval with conditions of the proposed
Site Specific Development Plan; and

WHEREAS, notice of the Site Specific Development Plan was given to all proper
agencies and departments as required by the Berry Creek/Miller Ranch PUD Guide and Land
Use Restrictions, dated 13 February 2002; and,
WHEREAS, at its public hearing held 7 May 2003, the Eagle County Planning
Commission, based upon its findings, recommended approval with conditions of the proposed
Site Specific Development Plan; and
•
' WHEREAS, at its regular hearing of 20 May 2003 the Eagle County Board of
Commissioners (hereinafter "Board"), considered the Site Specific Development Plan; associated
plans; and the statements and concerns of the Applicant, the Eagle County Community
Development and Engineering staff, and other interested persons; and the recommendation of the
Eagle County Planning Commission.
BASED ON THE EVIDENCE BEFORE IT, and with the modifications
imposed by the conditions hereinafter described, THE BOARD FINDS AS FOLLOWS:
Pursuant to the Berry Creek /Miller Ranch PUD Guide and Land Use Restrictions,
dated 13 February 2002, Section B.3., Development Review - HOUSInS Tract D:
Consistency with the PUD Guide [PUD Guide, Section B.3.] -The development
occurring on this Tract is consistent with the PUD Guide.
2. Consistency with the PUD Preliminary Plan [PUD Guide, Section B.3.] -The
development occurring on this Tract is consistent with the PUD Preliminary Plan.
3. Consistency with the Master Circulation Plan [PUD Guide, Section B.3.] - T$e
development occumng on this Tract is consistent with the Master Circulation
Plan.
4. Consistency with the Master Drainage Plan [PUD Guide, Section B.3.] -The
development occurring on this Tract is consistent with the Master Drainage Plan.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO:
THAT, the petition of Colorado Mountain College, File No. PR-00021, for approval of a
Site Specific Development Plan for the Alternative Use Tract A of the Berry Creek /Miller
Ranch PUD be and is hereby approved, subject to the following conditions:
The proposed development be revised to incorporate the changes requested by
Eagle County Engineering and Eagle County Facilities Management.
2. Prior to beginning construction, the Applicant provide such additional detail to
satisfy the Eagle County Engineer and the Director of Facilities Management that
the development will be adequately coordinated with other development in the
area and that all adverse or potentially adverse off-site impacts will be adequately
mitigated.

3. The bus access to the bus shelter for passenger pick-up be modified to improve
convenience and safety in a manner satisfactory to the Director of the Eagle
County Regional Transportation Authority and the Eagle County Engineer.
4. The Applicant provide a bond, or other form of collateral acceptable to the County
Attorney, to guazantee installation of landscaping.
5. Except as otherwise modified by these conditions, all material representations of
the Applicant in this application and in all public meetings shall be adhered to and
be considered conditions of approval.
THAT, the Building Elevations, attached hereto as Exhibits "A" and "B", respectively,
aze approved;
THAT, the Landscape Plans: Phase One, Phase Two and Phase Three, attached hereto
as Exhibit "C", Exhibit "D" and Exhibit "E", respectively,~aze approved.
THE BOARD further finds, determines and declazes that this Resolution is necessary for
the health, safety and welfare of the inhabitants of the County of Eagle, State of Colorado.
MOVED, READ AND ADOPTED by the Boazd of County Commissioners of the
County of Eagle, State of Colorado, at its regulaz meeting held the~~day °~~~~ 2003,
