COUNTY OF EAGLE, STATE OF COLORADO
RESOLUTION N0.2003 - J
A RESOLUTION NOTIFYING THE STATE TREASURER TO
DISTRIBUTE FEDERAL 1VIINERAL LEASING FUNDS IN
ACCORDANCE WITH THE PROVISIONS OF § 3463-102, C.RS.
WHEREAS, Section 34-63-102 of the Colorado Revised Statutes provides for a
distribution of a portion of those moneys received by the State Treasurer pursuant to the
provisions of the Federal Mineral Lands Leasing Act of February 25, 1920, for the use of public
schools and political subdivisions of the State of Colorado for the planning, construction, and
maintenance public facilities and for public services; and
WHEREAS, 34-63-102(3)(c), C.R.S., provides that each county shall notify the State
Treasurer to have at least twenty-five percent (25%) of the money described in 34-63-102(3)(a)
distributed to any school district within the county specified; and
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO:
THAT, the State Treasurer is hereby directed to distribute a total of twenty-five percent
(25%) of moneys described in 34-63-102(3)(a), C.R.S., to the school districts within Eagle
County.
THAT, the twenty-five percent (25%) allocated to the public school districts within the
county shall be divided in proportion to which the average daily pupil attendance of each district
during the preceding school year bears to the aggregate average daily pupil attendance in all
districts in Eagle County during said school year. The aggregate average daily pupil attendance
in Eagle County for the school year 2002-2003 is 5,672.1 pupils. The average pupil attendance
of each school district within Eagle County, and the resulting percentages, are as follows:

THAT, the Board further requests, in accord with Section 34-63-102 of the Colorado
Revised Statutes, that the State Treasurer disburse the remaining money allocable to Eagle
County to the Treasurer of Eagle County.
IT IS FURTHER RESOLVED that the office of the County Administrator is directed to
mail a copy of this Resolution to the State Treasurer as Eagle County's notification and direction
as to disbursement of said mineral leasing funds.

RE: Mineral Leasing Allocations to School Districts

Dear Board of County Commissioners:
Colorado statutes provide that at least 25% of the county share of the federal Mineral Lease
distribution be paid to school districts within the county. The statutes also require that
counties .report to the State Treasurer's office each calendar year regarding the percentage
breakdown-for distribution to each school district within the county boundaries. The law does
not allow the State Treasurer to disburse funds until the notifications are received.
If the county elects to have the distribution as per 34-63-102 (C)(II)(A), please designate the
year of election. The school district distribution will be as per statute, the most recent funded
pupil count, as determined pursuant to the "Public School Finance Act of 1994."
You are requested to submit the required notification by March 5, 2003 so that distributions for
calendar year 2003 can be made promptly. _
Please note that the mineral lease payment to the county may be paid electronically. If you
are not receiving these .payments electronically and would like to, please call Ms. Cindy
Johnson in my office at 303/866-4948. Mineral lease payments are made quarterly, usually
around the middle of the first month of the new quarter. The electronic abbreviation on your
bank statement for the payment will be MNRL LEASE. If you do not have electronic payments
and would like to receive your payments via EFT, please contact Cindy Johnson.
