CO 3 0 R 0.00 D 0.00 Commissioner moved adoption of the followgg Resolution: BOARD OF COUNTY COMMISSIONERS COUNTY OF EAGLE, STATE OF COLORADO RESOLUTION NO. 2001- lbl FINAL RELEASE OF COLLATERAL AND TERMINATION OF THE CORRECTION PERIOD FOR SOPRIS MESA SUBDIVISION WHEREAS, on August 31, 1998 Fender Lane Developers, Ltd. ( "Subdivider ") and the Board of County Commissioners of Eagle County, Colorado (hereinafter "Board ") entered into a Subdivisions Improvements Agreement (hereinafter "Agreement ") concerning the development of Sopris Mesa Subdivision; and WHEREAS, both the Subdivider and the Engineering Department state that the work required under the Agreement is complete and acceptable and the Engineering Department recommends full release of the collateral and the termination of the Subdivision Improvements Agreement, see Exhibit "A," attached hereto and incorporated herein by this reference. Based upon the oral and written recommendations of the County staff, THE BOARD FINDS that the Subdivider's obligations under the Agreement have been satisfied. WHEREAS, upon the recommendation of the Engineering Department and the dedication by Subdivider, Eagle County accepts the following roadways for maintenance and inclusion in the Eagle County Road Inventory: 1. A new portion of Green Meadow Drive (Eagle County Road GMl) extending from the north side of the traveled way at milepost 0.08 of Fender Lane (Eagle County Road 13A) in a northeast direction for approximately 4,694 -feet (0.89 miles) to the south end of the existing Green Meadow Drive. Said south end of Green Meadow Drive is approximately 70 -feet southwest of the centerline intersection with Milburn Court (Eagle County Road MC1); and 2. A new road called Sopris Mesa Place (proposed Eagle County Road SM1) extending from the west side of the traveled way at milepost 0.10 of Green Meadow Drive (Eagle County Road GMl) in a northwest direction for approximately 358 -feet (0.07 miles) to the end. WHEREAS, the one -year correction period required by Consent No. 2001 -16 be terminated. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO: C THAT, the Board hereby authorizes the full and final release of collateral and the termination of the Subdivision Improvements Agreement for Sopris Mesa Subdivision.. THAT, this document shall be recorded in the Records of the Eagle County Clerk and Recorder, which shall be evidence that the warranty period for Sopris Mesa has been successfully completed and that the Subdivider's obligations under the Agreement are complete. THAT, the Letter of Credit No. 1294 issued by Vectra Bank Colorado be returned. No. 669114, Dated August 31, 1998 On November 8, 2001, I inspected the public improvements covered by the above referenced Subdivision Improvements Agreement (SIA) in need of correction as noted in my letter of August 20, 2001. All of the items noted in that letter have been satisfactorily corrected. Consent No. 2001- 16 established a one -year correction period for these items. Due to the minor nature of the corrections that were made, it is my recommendation that the one -year correction period be terminated.
