RESOLUTION NO. 2001 - 2l,Q
AUTHORIZATION FOR CHAIRMAN TO SIGN AN APPLICATION
FOR A STATE HIGHWAY ACCESS PERMIT FOR HILLCREST DRIVE
(EAGLE COUNTY ROAD 28)
WHEREAS, Wilmore Development, LLC and Cordillera Valley Club Investors Limited
Partnership, LLC (the "Applicants ") have submitted an application for a State Highway Access
Permit (the "Permit ") per the State Highway Access Code Volume 2, Code of Colorado
Regulations 601 -1 (the "Code "); and
WHEREAS, the Permit application concerns the intersection of Hillcrest Drive (Eagle
County Road 28) and U. S. Highway 6; and
WHEREAS, the Applicants are developers of land served by Hillcrest Drive; and
WHEREAS, the Applicants want to have traffic generated by their developments
recognized as part of the Permit; and
WHEREAS, Eagle County is the Property Owner and Permittee for the existing Permit
for the Hillcrest Drive access to U.S. Highway 6; and
WHEREAS, in order for a Permit Application to be submitted, the Property Owner must
sign the application; and
WHEREAS, the Board of County Commissioners (the "Board "), decides how. Eagle
County Roads are to be used; and
WHEREAS, the Eagle County Engineering Department recommends to the Board that
they authorize the Chairman of the Board to sign the application as Property Owner; and
WHEREAS, the signature of the Chairman of the Board on the Permit application does
not guarantee approval of the Permit; and
WHEREAS, Eagle County has retained responsibilities as Issuing Authority for Permits
in Eagle County; and
WHEREAS, Eagle County may not be both the Permittee and the Issuing Authority.

NOW, THEREFORE be it resolved by the Board of County Commissioners of the
County of Eagle, State of Colorado:
THAT, the Board of County Commissioners hereby authorizes the Chairman of the Board
to sign the Permit application; and
THAT, Eagle County will not act as Issuing Authority for this Permit application, and
will defer the responsibility of Issuing Authority to the Colorado Department of Transportation
for this Permit Application.
MOVED, READ AND ADOPTED by the Board of County Comm stoners of the
County of Eagle, State of Colorado, at its regular meeting held the day of
2001.
