APPROVAL OF THE WILLITS FAMILY HOMESTEAD
PRELIMINARY PLAN
FILE NO. SUP -00004
WHEREAS, on or about March 19, 2001, the County of Eagle, State of Colorado,
accepted for filing an application submitted by Lloyd Willits and Robert Willits (hereinafter
p "Applicant ") for approval of the Preliminary Plan for Willits Family Homestead, File No. SUP -
00004; and,
WHEREAS, the Applicant requested the approval of a Subdivision Preliminary Plan
which would allow for the development as follows:
A subdivision consisting of 4 single family residential lots ranging in size from
15,177 square feet (0.35 acres) to 42,587 square feet (0.978 acres). Three of the
lots would accommodate existing dwelling units, one would provide a site for a
new home. Access to individual lots would be by Willits Circle, a short internal
street which provides access from Willits Lane. Water and sewer services would
be provided by the Mid Valley Metropolitan District.
WHEREAS, notice of the Preliminary Plan was given to all proper agencies and
departments as required by the Eagle County Land Use Regulations, Section 2.17.02(1); and,
WHEREAS, at its public hearing held May 17, 2001, the Roaring Fork Valley Regional
Planning Commission, based upon its findings, recommended approval of the proposed
Subdivision Preliminary Plan, with certain conditions; and `
WHEREAS, at its regular hearing of June 5, 2001, the Eagle County Board of
Commissioners (hereinafter "Board "), considered the Subdivision Preliminary Plan; associated
plans; and the statements and concerns of the Applicant, the Eagle County Community

Development and Engineering staff, and other interested persons; and the recommendation of the
Roaring Fork Valley Regional Planning Commission.
BASED ON THE EVIDENCE BEFORE IT, and with the modifications
imposed by the conditions hereinafter described, THE BOARD FINDS AS FOLLOWS:
Pursuant to Eagle County Land Use Regulations Section 5- 280.B.3.e. Standards for
the review of a Preliminary Plan for Subdivision:
CONSISTENT WITH MASTER PLAN. [Section 5- 280.B.3.e (1)] — The
PUD is consistent with the Master Plan, and it is consistent with the Future Land
Use Map (FLUM).
2) CONSISTENT WITH LAND USE REGULATIONS. [Section 5-
280.B.3.e (2)] — The subdivision does comply with all of the standards of this
Section and all other provisions of these Land Use Regulations, including, but not
limited to, the applicable standards of Article 3, Zone Districts and Article 4, Site
Development Standards
3) SPATLAL PATTERN SHALL BE EFFICIENT. [Section 5- 280.B.3.e (3)] —
The proposed subdivision is located and designed to avoid creating spatial
patterns that cause inefficiencies in the delivery of public services, or require
duplication or premature extension of public facilities, or result in a "leapfrog"
pattern of development.
4) SUITABILITY FOR DEVELOPMENT. [Section 5- 280.B.3.e (4)] —The
property proposed to be subdivided is suitable for development, considering its
topography, environmental resources and natural or man-made hazards that may
affect the potential development of the property, and existing and probable future
public improvements to the area.
5) COMPATIBLE WITH SURROUNDING USES. [Section 5- 280.B.3.e
(5)] — The proposed subdivision is compatible with the character of existing land
uses in the area and shall not adversely affect the future development of the
surrounding area.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO:

THAT, the application for approval of the Subdivision Preliminary Plan for the Willits
Family Homestead is hereby granted, subject to compliance with the following conditions:
1) That the Final Plat include a note that acknowledges the nonconformity of the
building labeled "shop" located on Lot 3, and states that future changes or
improvements to this building will be restricted per applicable Eagle County Land
Use Regulations.
2) That the Final Plat include a note that acknowledges the nonconformity of the
building labeled "mobile home" located on Lot 2, and states that future changes or
improvements to this building will be restricted per applicable Eagle County Land
Use Regulations.
3) That the Final Plat include a note that requires three (3) parking spaces per unit,
and that there be no on street parking on Willits Circle.
4) That the final plat include a note which requires that there be no obstruction of the
emergency vehicle turn- around and easement on Lot 2.
5) That measures for dog control, as referenced in the referral response from the
Colorado Division of Wildlife (letter of 01/13/00) be addressed prior to Final Plat
approval.
6) That a 17' building setback be established from the centerline of the Harris and
Reed irrigation ditch, to the north side of the Harris and Reed irrigation ditch.
7) That the Final Plat include a note that requires site specific soils investigations for
any new structures proposed for construction on the property, as requested by the
Colorado Geological Survey (05/08/01).
8) That concerns regarding a Water Use Report and irrigation water rights, as
detailed in the referral response from the State Engineer (05110101) be addressed
prior to Final Plat approval.
9) That all material representations made by the Applicant in submitted materials
and in public meetings shall be adhered to and considered conditions of approval,
unless otherwise amended by other conditions.
10) That off -site road impact fees and cash in- lieu -of school land dedication, as
determined by Eagle County Engineering and as defined by Eagle County Land
Use Regulations, be paid as required.

11) That an addressing scheme for the four lots be developed and approved by the
Eagle County Emergency 911 Coordinator prior to Final Plat approval.
THAT, the Preliminary Plan submitted under this application and hereby approved, does
constitute a "site specific development plan" as that phrase is defined and used in C.R.S. Section
24 -68 -101, et seq.
THE BOARD further finds, determines and declares that this Resolution is necessary for
the health, safety and welfare of the inhabitants of the County of Eagle, State of Colorado.
MOVED, READ AND ADOPTED by the Board of County Commission f the
County of Eagle, State of Colorado, at its regular meeting held the YGC"ay of ,
