RESOLUTION
OF THE
COUNTY OF EAGLE, STATE OF COLORADO
RESOLUTION NO. 2001- OW
AUTHORIZING THE CHAIRMAN OF THE BOARD
OF COUNTY COMMISSIONERS TO SIGN CDBG
CONTRACT CHANGE LETTER
WHEREAS, C.R.S. §30- 11- 101(1)(d) and (e) empower the Board
of County Commissioners of the County of Eagle, State of Colorado
(hereinafter referred to as the "Board ") to make all contracts
necessary to the exercise of its corporate or administrative
powers; and
WHEREAS, the County has a Community Development Block Grant
contract with the State of Colorado (hereinafter referred to as
the "State "), contract number H9CDB97767, in which federal funds
are granted for the County's Down Payment Assistance Program
which contract expires on June 30, 2001 (hereinafter referred to
as "CDBG contract "); and
WHEREAS, the County has received extensions in the past and
has requested a further extension of the CDBG contract to
December 31, 2001; and
WHEREAS, it i not possible to process contract amendments
while meeting both County and State procedural requirements and
practices without creating a gap period during which the HUD
funds are not available for the Down Payment Program; and
WHEREAS, discussion with the State has resulted in a change
in the amount of grant funding; and
NOW, THEREFORE BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO:
THAT, the Eagle County Board of County Commissioners hereby
authorizes the Chairman of the Board of County Commissioners to
sign the anticipated CDBG contract change letter, extending the
term of the CDBG Contract and changing the grant amount, provided
the contract change letter has been reviewed and found acceptable
by the County Attorney.

THAT, the Board authorizes Eagle County Housing Department
staff to take any action needed to implement the change letter.
THAT, all action (not inconsistent with the provisions of
this Resolution) heretofore taken by members of the Eagle County
Board of County Commissioners or staff toward extending the CDBG
contract and changing the grant amount shall be, and the same
hereby is, ratified, approved, and confirmed.
THAT,the Board finds, determines and declares that this
resolution is necessary for the public health, safety and
welfare of the citizens of Eagle County.
