ZC -00041 Abrams Subdivision WHEREAS, on September 20, 2000 the County of Eagle, State of Colorado, accepted for filing an application submitted by Steven J. Osterfoss (hereinafter "Applicant ") for approval of a Zone Change from Agricultural Residential to Agricultural Limited for the Abrams Subdivision File No. ZC- 00041, and; WHEREAS, at its public hearing held November 1, 2000 the Eagle County Planning Commission based upon its findings, recommended approval of the proposed Zone Change for the Abrams Subdivision and; WHEREAS, a public hearing was held by the Board of County Commissioners of the County of Eagle, State of Colorado, on November 20, 2000 and; WHEREAS, based on the evidence, testimony, exhibits, study of the Master Plan for the unincorporated areas of Eagle County, comments of the Applicant, comments of the Eagle County Department of Community Development, comments of public officials and agencies, the recommendation of the Planning Commission and comments from all interested parties, the Board of County Commissioners of the County of Eagle, State of Colorado, finds as follows: That proper publication and public notice was provided as required by law for the hearing before the Eagle County Planning Commission and the Board of County Commissioners; 2. That the Board reviewed the application pursuant to Eagle County Land Use Regulation Section 5 -230; 1111111 747485 01/04/2001 04:17P 370 Sara Fisher 1 of 3 R 0.00 D 0.00 N 0.00 Eagle CO C C Consistency with the Master Plan. [Section 5- 230.D.1] The proposed zone change designation IS consistent with the purposes, goals, policies and FLUM of the Eagle County Master Plan; 4. Compatible with surrounding uses. The zone amendment IS compatible with the uses that surround the applicant's property, and IS the appropriate zone district for the land; 5. Changed conditions. [Section 5- 230.D.3] There ARE changed conditions that require an amendment to modify the density and intensity; 6. Effect on natural environment. [Section 5- 230.D.4] The proposed amendment WILL NOT result in significantly adverse impacts to the natural environment; 7. Community need. [Section 5- 230.D.5] The proposed amendment DOES address a community need; Development patterns. [Section 5- 230.D.6] The proposed amendment WILL result in a logical and orderly development pattern and not constitute spot zoning. Further, the resulting development can logically be provided with necessary public facilities and services; 9. Public interest. [Section 5- 230.D.7] The extent to which the area to which the amendment would apply HAS changed and continues to change indicates that it is in the public interest to encourage a new density in the area; 10. That for the above stated reasons, the proposed zoning is in the best interest of the health, safety, convenience, order, prosperity and welfare of the citizens of the County of Eagle, State of Colorado. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of the County of Eagle, State of Colorado: THAT the petition of the Abrams Subdivision File Number ZC- 00041 for a Zoning Change from the Agricultural Residential Zone District to the Agricultural Limited Zone District be and is hereby APPROVED for the following described property located in the unincorporated area of Eagle County: Parcel B of The Amended Final Plat Seipel- Abrams Parcels, a parcel of land located in Tract 73, Section 24, Township 5 South, Range 84 West, of the 6' Principal Meridian, County of Eagle, State of Colorado. THAT the Board of County Commissioners directs the Director of the Department of Community Development to enter this amendment on the appropriate page of the Official District Map and to provide a copy of this Resolution to the Applicant.
