APPROVAL OF A COUNTY INITIATED ZONE CHANGE
FOR THE COLORADO RIVER RANCH PROPERTY TO RESTORE 'RESOURCE' ZONING
FILE NO. ZC-00085
WHEREAS, on May 8,2001 the Board of County Commissioners adopted :Resolution No.
2001-067 approving a Planned Unit Development (PUD) Preliminary Plan application for the
Colorado River Ranch PUD, Eagle County File No. PDP-00018. This PUD Preliminary Plan
approval was valid for five years; and
WHEREAS, on February 8, 2006 the Board of County Commissioners was petitioned by the
current owner of the Colorado River Ranch property with a request to extend the Preliminary Plan
approval for an additional two years beyond the expiration of the initial five year validity; and
WHEREAS, on March 28, 2006 following a public hearing on the request held on March 14,
2006, the Board of County Commissioners, via Resolution No. 2006-032, denied the request for
extension; and
WHEREAS, in accordance with the Eagle County Land Use Regulations, the Board of
County Commissioners initiated a hearing to determine whether to extinguish the PUD Preliminary
Plan. On October 23, 2006, the Community Development Department Director notified the property
owner of a hearing before an appointed hearing officer to occur on Thursday, November 30, 2006;
and
WHEREAS, on November 29, 2006, the property owner notified the County Attorney that
his client did not wish to proceed with the hearing and waived its right to such a hearing and would
not contest further the action of the Board of County Commissioners in refusing to grant a two year
extension of the PUD Preliminary Plan; and
WHEREAS, the Board of County Commissioners at its hearing on February 6, 2007
formally determined that the applicant failed to make the required showing necessary to extend the
PUD Preliminary Plan and found that said plan should be extinguished for that reason, and by
Resolution dated February 20, 2007, formally terminated the Planned Unit Development Preliminary
Plan.

WHEREAS, on or about March 16, 2007, the County of Eagle, State of Colorado, initiated
an application to re-zone the herein described property in Eagle County from the Planned Unit
Development [PUD] Zone District to the Resource [R] Zone District, Eagle County File No. ZC-
00085; and
WHEREAS, at its public hearing held on May 16, 2007 the Eagle County Planning
Commission, based on its findings, recommended approval ofthe proposed Zone Change from PUD
to Resource; and
WHEREAS, a public hearing was held by the Board of County Commissioners (hereinafter
the "Board") of the County of Eagle, State of Colorado, on May 29,2007; and
WHEREFOR, based on the evidence, testimony, exhibits, and study ofthe C.omprehensive
Plan for the unincorporated areas of Eagle County, comments of the Eagle County bepartment of
Community Development, comments of public officials and agencies, the recommendation of the
Planning Commission, and comments from all interested parties, the Board of County
Commissioners of the County of Eagle, State of Colorado, finds as follows:
That proper publication and public notice were provided as required by law for hearings
before the Planning Commission and the Board; and,
Pursuant to Eagle County Land Use Regulations, Section 5-230.D. Standards for a Zone
Change:
STANDARD: Consistency with the Comprehensive Plan. [Section 5-230.D.l] Does the
proposed amendment consider the purposes and intents of the Comprehensive Plan, all
ancillary County adopted Specialty and Community Plan documents, and is it consistent
with all relevant goals, policies, implementation strategies and Future Land Use Map
designations including but not necessarily limited to the following:
Section 3.2 General Development Policies a, c, e, f, g, h, i and k
· Policy 'a' states that, "Those attributes that support quality oflife options
unique to Eagle County today should be preserved for future generations".
This proposal to restore 'Resource' zoning on the subject property satisfies
this policy.
· Policy 'c' states that, "Growth should be managed toward future sustainability
- a healthy balance between economic success, quality of life and the
preservation of the environment". Not applicable.
· Policy 'e' states tha~, "Urban and suburban type growth should be
appropriately designed and should be located within or immediately
contiguous to existing towns and community centers". This proposal to
restore 'Resource' zoning on the subject property satisfies this policy.

economic structure that promotes a coherent regional 'community' while

Change to change the zoning of the Colorado River Ranch from the Planned Unit Development
[PUD] Zone District to the Resource [R] Zone District, Eagle County File No. ZC-00085 for the
following described property, attached as Exhibit' A', located in the unincorporated area of Eagle
County subiect to compliance with the following condition:

I) That Eagle County Code Enforcement verify that existing uses and structures on
the Colorado River Ranch property are consistent with uses and structures allowed
within the 'Resource' zone district.

THAT the Board of County Commissioners directs the Director of Community
Development to enter this amendment on the appropriate page of the Official Zone District Map
and to provide a copy of this Resolution to the applicant.
THAT the Board hereby finds, determines and declares that this Resolution is necessary
for the health, safety and welfare of the inhabitants of the County of Eagle, State of Colorado.
