APPROVAL
OF THE SPECIAL USE PERMIT
for THE ACKERMAN ACCESSORY DWELLING UNIT
FILE NO. ZS-00153
WIlEREAS, on or about January 240., 2007, the County of Eagle, State of Colorado, accepted
for filing an application submitted by 000 E. Ackerman Trust (hereinafter "Applicant') for a Speciat Use
Pennit for an Accessory Dwelling Unit, located in tbe Resource Zooe District in the unincorporated area of
Eagle County described as follows:
1935 W. Lake Creek Rd; Cattleman's Club (William's Parcels, Parcel I); Section 18, Townsblp 5
South, Range 82 West; Couoty of Eagle, State of Colorado (see attached Exhibit 'A'); and
WHEREAS, the applicaot is proposing to construct a primary dwelling unit and a detached
Accessory Dwelling Unit (ADU); and
WHEREAS, per the Eagle County Land Use Regulations, the Resource Zone District pennits an
Accessory Dwelling Unit of up to 1800 square feet as a 'use by rigbt' on conforming properties 013 5 acres
or greater; the Ackerman property is comprised of 4.54 acres rendering it a (legal), nonconfonning
property. As such, the ADU use rcquires this Special Use Permit in lieu of a 'use by right' via building
permit in order to assess the potential land use with a more detailed analysis; and
WHEREAS, the applicant has created a design for an ADU consisting of 1273 square feet;
however, tbe mal< flour area limitation pursuant to this Special Use pennit is 1500 square feet; and
WHEREAS, the Cattleman's Club is an existing "development" comprised of three (3) platted
parcels (Wi1Iiams Parcels Subdivision- Parcels 1-3) and five (5) unplatted parcels 0135 acres in size
(Parcels 4-8); and
WHEREAS, the Special Use Permit request was coosidered at a public meeting by the Eagle
County Planning Commission on April 5th, 2007; and
WHEREAS, the Special Use Permit request was considered at a public meeting by the Eagle
County Board of County Commissioners on May 16th, 2007; and

(Parcels 4-8); and
WHEREAS, the Special Use Permit request was considered at a public meeting by the Eagle

WHEREAS, the Special Use Permit request was considered at a public meeting by the Eagle
County Board of County Commissioners on May 16th, 2007; and
