RESOLUTION NO. 2007- 0 (fir
RESOLUTION EXTENDING FOR THE YEAR 2007:
THE TIME PROVISION FOR THE EAGLE COUNTY ASSESSOR TO RESPOND
TO PROTESTS CONCERNING VALUATIONS OF TAXABLE REAL PROPERTY; THE
TIME PROVISION FOR T AXP AYERS TO APPEAL TO THE COUNTY BOARD OF
EQUALIZATION; AND TIME PROVISION FOR THE COUNTY BOARD OF
EQUALIZATION TO CONDUCT HEARINGS AND RENDER FINAL DECISIONS
WHEREAS, pursuant to the provisions of C.R.S. ~39-5-122, the Assessor of the County
of Eagle, State of Colorado, is required to hear all objections and protests concerning valuations
of taxable real property and to provide notice of the Assessor's determination on or before the last
regular working day in June, 2007; and
WHEREAS, pursuant to the provisions of C.R.S. ~39-8-106, persons who wish to appeal
the Assessor's determination may petition the County Board of Equalization to adjust the
valuation of taxable real property made by the Assessor, and such petition must be postmarked on
or before July 15,2007; and
WHEREAS, pursuant to the provIsIons of C.R.S. ~39-8-102, the Board of County
Commissioners of the County of Eagle, State of Colorado, acting in its capacity as the Eagle
County Board of Equalization (hereinafter the "Board"), has the authority to review the
evaluations for assessment of all taxable property appearing in the assessment roll of the County,
correct errors made by the Assessor, and whenever in its judgment, justice and right so require it
to raise, lower or adjust any valuation for assessment appearing in the assessment roll to the end
that all valuations for assessment of property are just and equalized within the County; and
WHEREAS, pursuant to C.R.S. ~39-8-107, the Board is to conduct hearings until all
petitions have been heard and is to render all decisions by the close of business on August 5,
2007; and
WHEREAS, in order to afford the opportunity for the Assessor to review all petitions and
for the Board to conduct all hearings, the Board deems it necessary to extend the time periods in
which the Assessor is to mail its notice of determination until close of business on July 6, 2007;
the taxpayer is to deliver its petitions until close of business on July 23,2007; and the Board is to
hold its hearings and render its decisions until close of business on August 10, 2007;
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO, sitting in
its capacity as the County Board of Equalization:
THAT, the Eagle County Assessor shall have until the close of business on July 6, 2007,
to render all decisions and mail notices of determination concerning the valuation of taxable real
property.
THAT, the taxpayers of Eagle County shall have until the close of business on July 23,
2007, to mail or deliver petitions of appeal concerning the valuation of taxable real property to the
Eagle County Board of Equalization; and
THAT, the Eagle County Board of Equalization shall have until the close of business on
August 10, 2007, to conclude all hearings and render all decisions concerning the valuation of
taxable real property.
THAT, said decision is to enable the Assessor to review all protests and objections
concerning the valuation of taxable real property, to allow taxpayers an extra week within which
to appeal to the Board, and to enable the County Board of Equalization to conduct hearings, and
to achieve equalization within the County.
THAT, said decision is in the best interest of the taxpayers of Eagle County and shall not
deprive any person within the County of hislher right to appeal the decision of the Board to
another level pursuant to C.RS. ~39-8-107.
MOVED, READ AND ADOPTED by the Board of County Commissioners of the
County of Eagle, State of Colorado, at its regular meeting held this 19th day of June, 2007.
