RESOLUTION NO. 07 - {jq-;:r
RESOLUTION AUTHORIZING THE RELEASE OF THE JULES DRIVE EXTENSION
PARCEL AND AUTHORIZING THE APPLICATION TO THE FEDERAL AVIATION
ADMINISTRATION FOR SUCH RELEASE
WHEREAS, the Town of Gypsum desires to construct an extension of its street system, to be
known as the Jules Drive Extension, in a location on the Eagle County Regional Airport property
as shown on the attached maps and legal descriptions attached hereto as Exhibit "A."
WHEREAS, the Jules Drive Extension Parcel was originally acquired by the County with
funding assistance from the Federal Aviation Administration.
WHEREAS, Eagle County and the Town of Gypsum executed an Intergovernmental Agreement
Regarding Jules Drive Extension on February 9, 1999, a copy of which is attached hereto as
Exhibit "B." Pursuant to this Agreement, the County stipulated to conveying to the Town the
Jules Drive Extension Parcel.
WHEREAS, the To~n agreed to pay at its sole expense for the design and construction of the
Jules Drive Extension, as well as to compensate the County, in cash or real property, at fair
market value for the Jules Drive Extension parcel pursuant to FAA release procedures.
WHEREAS, the County has obtained a recent appraisal dated September 8, 2006 by Rocky
Mountain Valuation Specialists. The appraisal report shows an estimated value for the Jules
Drive Extension Parcel of $210,000.00.
WHERAS, the County and the Town entered into an Addendum to the Intergovernmental
Agreement Regarding Jules Drive Extension on April 27, 1999, wherein the County and Town
agreed to a purchase price of $125,463.00 in cash for the Jules Drive Extension Parcel which
represented the appraised value less credits given by the Town to the County for tap and other
development fees associated with the County's Joint Maintenance Center construction.
WHEREAS, the proposed location of the Jules Drive Extension Parcel has been shown on the
Airport Layout Plan and Airport Master Plan since the execution of these various agreements
with the Town of Gypsum.
WHEREAS, the Town of Gypsum is now desirous of moving forward with the construction of
the Jules Drive Extension.
WHEREAS, the Federal Aviation Administration release procedures require a resolution from
the sponsoring Airport authorizing the sale and release of the Jules Drive Extension Parcel and a

resolution obligating itself to use the proceeds of the sale exclusively for developing, improving,
operating, or maintaining the Eagle County Regional Airport.
WHEREAS, the County is supportive of authorizing said release under these terms and
conditions.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO:
THAT, the Eagle County Board of County Commissioners hereby authorizes the sale
and release of the Jules Drive Extension Parcel to the Town of Gypsum for the sole use of said
property as a public roadway.
THAT, the Eagle County Board of County Commissioners hereby obligates itself to use
the proceeds of the sale exclusively for developing, improving, operating, or maintaining the
Eagle County Regional Airport.
THAT, the County Attorney, on behalf of the Eagle County Board of County
Commissioners, is hereby authorized to make application to the Federal Aviation Administration
to effectuate the release of the Jules Drive Extension Parcel to the Town of Gypsum
THAT, the Board hereby finds, determines and declares that this Resolution is necessary
for the public health, safety and welfare of the residents of the County of Eagle, State of
Colorado.
