RESOLUTION NO. 84 -24
IN RE THE MATTER OF THE APPLICATION OF LESLIE SHAPIRO: GERALD
REA AND VAIL LANDWEST FOR P.U.D. - SKETCH PLAN APPROVAL, FILE
NO. PD-- 244- -84 - -5 SQUAW CREEK RECREATIONAL P.U.D.
WHEREAS Leslie Shapiro, Gerald Rea, and Vail Landwest
did on September 17: 1984 make application for approval of the
Planned Unit Development (P.U.D,) Sketch Plan for Squaw Creek
Recreational P.U.D. located on a parcel of land, described as
follows:
LOTS 6 AND 7 E1 /2SW1 /4 AND W1 /2SE1 /4 OF SECTION 6, IN
TOWNSHIP 5 SOUTH, RANGE 82 WEST OF THE 6TH PRINCIPAL MERIDIAN,
AND LOTS 9, 10, 11, 14, 15, 16; 19, 20 AND 21 E1 /2SW1 /4 OF
SECTION 1, IN TOWNSHIP 5 SOUTH, RANGE 83 WEST OF THE 6TH
PRINCIPAL MERIDIAN, COUNTY OF EAGLE, STATE OF COLORADO.

LOTS 2, 3, 4, 5, 6 AND 7, AND THE NE 1/4 OF SECTION
12; LOTS 17 AND 18 SECTION 1, AND THAT PART OF TRACT NO. 57 OF
SECTIONS 11, 12, 13 AND 14, LYING EAST OF THE RIGHT OF WAY OF
THE COUNTY ROAD AS DESCRIBED IN DEED RECORDED IN BOOK 116 AT
PAGE 40 IN THE RECORDS OF EAGLE COUNTY, COLORADO, ALL IN
TOWNSHIP 5 SOUTH. RANGE 83 WEST OF THE 6TH P.M -, OF EAGLE, STATE
OF COLORADO; and
WHEREAS, the P.U.D. Sketch Plan involves 110 single
family units clustered on 450 acres of the 1,100 acre parcel and
30 units in a townhouse type arrangement on a forty acre tract.
The forty acre tract would also include a clubhouse and a
restaurant to service the development and users of the ski
touring trails in the development- and
WHEREAS, the Planning Commission held a Public Hearing
with regard to said P.U.D. Sketch Plan Application on November
19, 1984, and at the Public Hearing a Motion to approve the
Sketch Plan for 140 units on the above described property was
defeated by a 2 -3 vote, thus effectively recommending denial of
the Sketch Plan; and
WHEREAS, the planning staff of the Eagle County
Department of Community Development has recommended Sketch Plan
approval of the P.U.D.; and
WHEREAS, the Board of County Commissioners held a
Public Hearing on December 26, 1984; the requisite Public Notice
having been given; and
WHEREAS, the Board duly considered the evidence
presented at said hearing including those written comments
received from the Public and other agencies' which were admitted
into the record at the hearing, the arguments of the opponents
and proponents of the project, along with the requirements of
the Eagle County Land Use Regulation; and
WHEREAS, the Board of County Commissioners of the
County of Eagle find that applicant has shown the proposed
P.U.D. Sketch Plan meets the Sketch Plan review requirements of
Section 2.06.13(5) in that:
(1) There are special physical conditions or
objectives of development which the proposal will
satisfy to warrant a departure from the standard
regulation requirements;
(2) Resulting development will not be inconsistent
with the Master Plan objectives;
(3) The area around the development can be planned to
be in substantial harmony with the proposed P.U.D.;
(4) The adjacent and nearby communities will not be
detrimentally affected by the proposed P.U.D,;
(5) The P.U.D. can be completed within a reasonable
period of time, which shall be determined prior to
final approval of the P.U.D.;

(5) Any proposed commercial or industrial development
can be justified;
(7) The employee housing plan as provided is
acceptable;
(8) The land is suitable for subdivision.
The Board of County Commissioners, however, reserves the right
to further review and address the questions of whether:
(1) The streets are adequate to support the
anticipated traffic and the development will not
overload the streets outside the planned area,
(including the question of specific off- -site road
impacts).
(2) Proposed utilities and drainage facilities are
adequate for population densities and type of
development proposed, at the Preliminary Plan stage;
and
WHEREAS, the Board of County Commissioners finds that
in the proposed Sketch Plan the applicant has shown the project
to be consistent with the intent of the Master Plan and the
policies therein, in that the proposed plan:
(1) Would help to protect the open rural character of
Eagle County. That the land uses in the proposed
Sketch Plan are in harmony with the natural
environment, the social environment and adjacent land
use.
(2) That this land

(5) With proper action by the Board and the
applicant, it can be insured that this development can
pay for a fair share of the costs associated with the
development's demands on the community.
(6) The cross country skiing portion of the proposed
project is an amenity feature which may possibly in
the future be an additional economic stimulus and
might encourage and strengthen the recreational
industry. The proposed recreational amenities are
compatible with existing recreational activities.
(7) Would provide and maintain multiple use
recreational activities to meet the wide range of
needs of the County residents and visitors.
(8) However, the Board of County Commissioners is
required to again review the proposed P.U.D. at the
preliminary plan stage for consistency with the intent
of the Master Plan.
WHEREAS, the Board of County Commissioners at the
public hearing held on December 26, 1984, by a vote of 3 -0 did
indicate their condition approval of the Squaw Creek
Recreational P.U.D. sketch plan and did direct the Assistant
County Attorney to prepare this resolution containing the
Board's formal finding and order, and
NOW THEREFORE BE IT RESOLVED that the Sketch Plan for
the Squaw Creek Recreational Planned Unit Development is hereby
conditionally approved subject to the following special
conditions in addition to those requirements applied to all
Planned Unit Developments by the Eagle County Land Use
Regulations which conditions shall be fully complied with by the
applicant during the preliminary plan review process and prior
to preliminary plan approval by the Board of County
Commissioners:
(1) That the applicant consider relocating the
location of the proposed ski lift to an area less
visually sensitive and in such a manner so as to
mitigate potential impacts on wildlife.
(2) That the applicant should submit information
regarding ownership and maintenance of open space,
private roads and other common facilities. Issues
concerning public control or ownership of fire, water,
sanitation road improvements and road maintenance
shall be addressed by the applicant to the

satisfaction of the Board of County Commissioners at
the preliminary plan. The Board notes that these
matters have not been fully addressed to the Board of
County Commissioners satisfaction in the Sketch Plan
application_
(3) At the preliminary plan stage, off site .road
impacts including improvement requirements must be
adequately addressed. The applicant shall provide
detailed engineering information regarding the
proposed access including information regarding the
intersection of U.S. Highway 6 and Squaw Creek Road,
and a specific study as to traffic volumes that might
require improvements to this intersection and the
nature of the improvements that will be required.
(4) That an adequate plan for bringing the roads in
the project and access to the projects to County
standards be presented.
(5) That the preliminary plan shall address
satisfactorily the questions of the sanitation. water
and fire protection needs of the village core and
multi - family residential units.
(6) Additional buffer zones shall be provided on the
west end of the project towards the area commonly
known as the Squaw Creek Schoolhouse area and on
eastern end of the proposed P.U.D. in the Lake Creek
drainage, because of the steepness of the slopes and
the visual obtrusiveness. These buffer zones could be
achieved by eliminating units or relocating units in
village cluster.
(7) The building envelopes shall be established on
all lots, and the building envelopes established
outside any area of geological or know soil hazards.
(8) Soils and geological studies shall. be completed
and presented with the application for Preliminary
Plan approval.
(9) A plan for coordinated phasing of the off -site
road improvements and development of the Squaw Creek
Recreational P.U.D. shall be presented with the
application for the P.U.D. Preliminary Plan approval.

THAT, the provisions of this Resolution and the
conditional approval of the Board of County Commissioners of the
Squaw Creek Recreational P.U.D. Sketch Plan application
contained herein shall not be deemed or construed to be deemed
as conferring any additional rights upon the applicant other
than the right to proceed with the preliminary plan in
accordance with the County's Land Use Regulations.
THAT, this Resolution is necessary to preserve the
public's welfare, health and safety.
MOVED, READ AND ADOPTED by the Board of County
Commissioners of the County of Eagle, State of Colorado, at its
regular meeting held on 27th day of December, 1984, nunc pro
tune December 26, 1984.
