COUNTY OF EAGLE, STATE OF COLORADO
RESOLUTION NO. 84 -�
APPROVAL OF SPECIAL USE PERMIT - Lot 10, New York Mountain
FILE No. ZS- 211 -84
WHEREAS, i -plan did file an
application with the Eagle County Department of Community
Development on or about August 15, 1984 within
the Resource Zone District; and
WHEREAS, a public hearing was held by the Board of
County Commissioners of the County of Eagle, State of
Colorado, on September 26 , 1984; and
WHEREAS, based on the evidence, testimony, exhibits,
study of the Master Plan for the unincorporated areas of
Eagle County, comments of the Eagle County Department of
Community Development, comments of public officials and
agencies, the recommendation of the Eagle County Planning
Commission, and comments from all interested parties, the
Board of County Commissioners of the County of Eagle, State
of Colorado, finds as follows:
1. That proper publication and public notice was
provided as required by law for the hearing before the
Planning Commission and the Board of County Commissioners.
2. That the proposed special use conforms to the
requirements of Section 2.09 of the Eagle County Land Use
Regulations.
3. That the proposed land use will be compatible
with existing uses in the area.

4. That for the above- stated and other reasons,
the proposed zoning is in the best interest of the health,
safety, morals, convenience, order, prosperity and welfare of
the citizens of Eagle County.
NOW, THEREFORE, BE IT RESOLVED, by the Board of County
Commissioners of the County of Eagle, State of Colorado:
That the application of i =plan ,
File No. ZS- 211 -84 , for approval of a special use
of Lot 10, New York nitn. within the Resource Limited Zone
District in the following described unincorporated area of
Eagle County be approved:
LEGAL DESCRIPTION
SE-, SE', Section 19, Township 5 South, Range
28 West, 6th P.M., beginning at NW corner of
said 4, n Section, thence South 88 °08'01" East
1269.68 feet, thence South 04° 22'34" East
1275.23 feet, thence North 86 °28'05" West
1299.54 thence North 03 °12'51" West 1234.75
feet to the point of beginning.
THAT the following conditions shall be placed upon
this approval and that violation of any condition shall be
the basis for revocation of the permit:

THAT the Board of County Commissioners directs the
Department of Community Development to provide a copy of this
Resolution to the applicant.
MOVED, READ, AND ADOPTED by the Board of County
Commissioners of the County of Eagle, State of Colorado, at
