HomeMy WebLinkAboutR84-60 special use permit Joe MurphyRESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS COUNTY OE' EAGLE, STATE OF COLORADO RESOLUTION NO. 84- 6d APPROVAL OF SPECIAL USE PERMIT - Joe Murphy FILE No. ZS- 202 -84 WHEREAS, Joe Murphy did file an application with the Eagle County Department of Community Development on or about May 1, 1984 , within the Resource Zone District; and WHEREAS, a public hearing was held by the Board of County Commissioners of the County of Eagle, State of Colorado, on June 27 , 19 84 ; and WHEREAS, based on the evidence, testimony, exhibits, study of the Master Plan for the unincorporated areas of Eagle County, comments of the Eagle County Department of Community Development, comments of public officials and agencies, the recommendation of the Eagle County Planning Commission, and comments from all interested parties, the Board of County Commissioners of the County of Eagle, State of Colorado, finds as follows: 1. That proper publication and public notice was provided as required by law for the hearing before the Planning Commission and the Board of County Commissioners. 2. That the proposed special use conforms to the requirements of Section 2.09 of the Eagle County Land Use Regulations. 3. That the proposed land use will be compatible with existing uses in the area. 4. That for the above - stated and other reasons, the proposed zoning is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Eagle County. NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners of the County of Eagle, State of Colorado: That the application of Joe Murphy , File No. ZS- 202 -84 for approval of a special use of Sawmill within the Resource Zone District in the following described unincorporated area of Eagle County be approved: GAL DESCRIPTION Long Parcel A parcel of land located in Tract 39, Township 5 South, Range 86 West of the 6th Principal Meridian, County of Eagle, State of Colorado, according to the Independent Resurvey of said township and range as ap- proved by the U.S. Surveyor General in Den- ver, Colorado, on June 20, 1922, and south- erly of and adjoining Interstate 70. Said parcel being more specifically described as follows: Beginning at the point of intersection of line 2 -3 of Tract 39 and the southerly right - of -way of Interstate 70, whence angle point 2 of said Tract 39, being a brass cap, bears North 00005111" East, 695.50 feet; thence South 00085111" West, 626.45 feet on line 2 -3 of said Tract 39 to angle point 3 of said Tract 39, being a brass cap; thence South 89055'06" East, 2191.83 feet on line 3 -4 of Tract 39; thence North 060001471' West, 401.76 feet to a point on the southerly right -of -way of Interstate 70: thence South 23040100" West, 533.54 feet on the southerly right -of -way of Interstate 70; thence North 88009'00°' West, 431.90 feet of the southerly right -of -way of Interstate 70; thence North 30030'30" West, 428.80 feet on the southerly right -of -way of Interstate 70; thence North 75002'00" West, 790.80 feet on the southerly right -of -way of Interstate 70 to the place of beginning. Said parcel contains 21.1096 acres, more or less. 2 ra THAT the following conditions shall be placed upon this approval and that violation of any condition shall be the basis for revocation of the permit: 1. A drainage plan must be developed and implemen- ted in accordance with the letter from Rick Olson, Soil Conservation Service agent, dated May 22, 1984. 2. Sound levels should not exceed 60 decibels at the property boundary. THAT the Board of County Commissioners directs the Department of Community Development to provide a copy of this Resolution to the applicant.
