RESOLUTION NO. 84 -57
Adopted: September 27, 1984
A RESOLUTION AUTHORIZING A PUBLIC HEARING WITH
RESPECT TO ISSUANCE OF REVENUE BONDS FOR A SPORTS
FACILITIES PROJECT FOR BEAVER CREEK ASSOCIATES,
INC.; AUTHORIZING PUBLICATION OF NOTICE OF PUBLIC
HEARING; AUTHORIZING A HEARING WITH RESPECT TO
BOND ISSUANCE BY TOWN OF VAIL FOR VAIL MOUNTAIN
IMPROVEMENTS; AUTHORIZING REPRESENTATIVES OF THE
COUNTY TO TAKE ACTION INCIDENTAL THERETO; AND
PROVIDING THE EFFECTIVE DATE OF THIS RESOLUTION.
WHEREAS, Eagle County is authorized, pursuant to the
Colorado County and Municipality Development Revenue Bond Act,
as amended (the "Act "), to issue revenue bonds for the purpose
of defraying the cost of financing any land, buildings or other
improvements suitable for sports and recreational facilities,
upon such conditions as the County may deem advisable; and
WHEREAS, Eagle County has approved the financing of
sports facilities, improvements to the Beaver Creek Mountain
recreation complex (the "Beaver Creek Project ") for Beaver Creek
Associates, Inc. (the "Company ") by resolutions adopted February
27, 1979, January 7, 1980, February 25, 1981 and August 3, 1982;
and
WHEREAS, Vail Associates, Inc. has requested the Town
of Vail to issue industrial development revenue bonds to assist
in the financing of certain improvements on Vail Mountain (the
"Vail Project ") located in the unincorporated area of Eagle
County; and
WHEREAS, pursuant to Section 103(k) of the Internal
Revenue Code of 1954, as amended (the "Code "), interest on
industrial development bonds is not exempt from federal income
tax unless such bonds receive public approval "by the applicable
elected representative of such governmental unit after a public
hearing following reasonable public notice."
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO, AS
FOLLOWS:
Section 1. Public Hearing. A public hearing shall be
held by the Board of County Commissioners, at the time and place
as is indicated in the form of notice hereinafter described for
the purpose of considering the proposed issuance by the County
of its Bonds to finance the Beaver Creek Project. The hearing
shall be conducted in a manner that provides a reasonable
opportunity for persons with differing views to be heard on both
the issuance of the County's Bonds for the Beaver Creek Project
and the location and nature of the proposed facility. Such
hearing shall be held in conjunction with the County's
consideration of a resolution authorizing and giving final
approval to the issuance of such Bonds.
Section 2. Publication of Notice. The County Clerk
be, and she hereby is, authorized and directed to publish a
notice of such public hearing at least one time in newspapers
having general circulation in the County, which shall be "The
Eagle Valley Enterprise" and "The Vail Trail ", not less than 14
days prior to the date of the public hearing, in order to
apprise residents of Eagle County of the proposed issuance of
the County's Bonds. The official notice of public hearing shall
be substantially in the form attached to this resolution, with
such changes therein and completions thereto as the Chairman or
Chairman Pro Tem shall direct and shall deem to be in accordance
with the requirements of the Code.
Section 3. Hearing Regarding Proposed Issuance of
Bonds by Town of Vail. In view of the requirement of the Code
that the County hold a public hearing in respect of the proposed
issuance by the Town of Vail of its bonds to finance the Vail
Project, a hearing in respect of such issuance shall be
conducted by the Town Council of the Town of Vail on behalf of
the County on October 16, 1984 at 7:30 P.M. The Vail Town
Council is hereby appointed for such purpose, and the County
Clerk is hereby directed to notify the Town of Vail of such
appointment.

Section 4. Authorization of County Representatives to
Take Action in Connection Herewith. The appropriate officers
and representatives of the County are hereby authorized and
directed to take all action necessary to accomplish the purposes
of this resolution.
Section 5. Effective Date. This resolution shall take
effect immediately upon its adoption.
MOVED, READ AND ADOPTED by the Board of County
Commissioners of the County of Eagle, State of Colorado, at its
regular meeting held the 27th day of September, 1984.

NOTICE OF PUBLIC HEARING REGARDING ISSUANCE
OF EAGLE COUNTY INDUSTRIAL DEVELOPMENT
REVENUE BONDS FOR BEAVER CREEK ASSOCIATES
PROJECT.
NOTICE IS HEREBY GIVEN that the Board of County
Commissioners of Eagle County, Colorado, will hold a public
hearing at the McDonald Building, 550 Broadway, Eagle, Colorado,
on November 7, 1984, at the hour of 9:30 A.M., or as soon
thereafter as possible, on the proposed issuance by the County
of its industrial development revenue bonds in an aggregate
principal amount not to exceed $14,000,000.00, for the purpose
of financing the construction of improvements and additions to
the Beaver Creek Mountain improvements and additions to the
Beaver Creek Mountain recreation complex owned and operated by
Beaver Creek Associates, Inc. to be located at various locations
on Beaver Creek Mountain in unincorporated Eagle County.
Folowing the hearing, the County Commissioners will consider and
act upon a resolution authorizing the financing of the project
and the issuance of the bonds. All interested persons are
invited to attend the public hearing, which will be the only
public hearing held prior to the consideration of the resolution
by the County and the issuance of the bonds.
