HomeMy WebLinkAboutR84-35 1041 for upper eagle valley sanitation's = Commissioner ,` / /,��js moved adoption following Resolution: PERMIT AUTHORITY COUNTY OF EAGLE, STATE OF COLORADO RESOLUTION NO. 84- e96 U. 5 4 1 of 4�lr f TE FHILLIRS 61`( +.E CORDER AMENDMENT TO THE H.B. 1041 PERMIT ISSUED TO UPPER EAGLE VALLEY SANITATION DISTRICT, COUNTY OF EAGLE, STATE OF COLORADO, APPROVING MAJOR EXTENSIONS TO THE DISTRICT'S "IL i? � -3 47 P14 I'l EXISTING DOMESTIC WATER AND SEWAGE TREATMENT SYSTEM WHEREAS, pursuant to the Guidelines and Regulations for Areas and Activities of State Interest of the County of Eagle, State of Colorado, 1980, as amended, the Eagle County Permit Authority did on April 25, 1984, adopt Resolution No. 84 -13 which approved the application of the Upper Eagle Valley Sanitation District, County of Eagle, State of Colorado ( "District "), for a permit to conduct the following activity of State Interest: major extensions of an existing water and sewage treatment systems, for the purpose of extending sewage lines and service to the following subdivisions: Arrowhead at Vail; Homestead; Brett Ranch; Berry Creek; Beaver Creek; Edwards Village; Old Edwards Estate; Sage Flats; and Reserve on the Eagle River, as the foregoing are more particularly described in the respective final plats recorded thereof in the real property records of the County of Eagle, State of Colorado. The aforementioned permit also included the Squaw Creek wastewater treatment facility presently constructed on the north side of the Eagle River, approximately 1/4 mile upstream from Squaw Creek, in the NW 1/4 of Section 36, Township 4 South, Range 82 West, approximately two (2) miles west of Edwards, Colorado; and WHEREAS, by letter dated May 7, 1984, the District filed with the Eagle County Permit Authority a request for an amendment to the afor- ementioned permit for the purpose of extending its sewage 1 -ines -and service to the Eagle Bend and Cliffside Subdivisions, as the foregoing are more particularly described in the respective final plats recorded thereof in the real property records of the County of Eagle, State of Colorado; and WHEREAS, a public hearing regarding the aforementioned amendment was duly scheduled before the Eagle County Permit Authority on July 11, 1984; and WHEREAS, public notice of the subject public hearing was duly published in the Eagle Valley Enterprise on June 7, 1984, and mailed to interested governmental entities; and WHEREAS, the Eagle County Permit Authority, having reviewed and considered the recommendations of the Eagle County Planning Commission and the testimony and evidence presented at the public hearing on the requested permit amendment, hereby finds, determines and declares to approve the said requested amendment to the District's H.B. 1041 permit. NOW, THEREFORE, BE IT RESOLVED BY THE EAGLE COUNTY PERMIT AUTHORITY: THAT, Resolution No. 84 -13 is hereby amended to authorize the extension of the District's sewage lines and service to the Eagle Bend and Cliffside Subdivisions, as the foregoing are more particularly described in the respective final plats recorded thereof in the real property records of the County of Eagle, State of Colorado. THAT, the aforesaid amendment shall become effective upon adoption by the Eagle County Permit Authority, and the recording thereof in the property records of the County of Eagle, State of Colorado. THAT, the entirety of Resolution No. 84 -13, as herein amended, is hereby readopted. THAT, the aforesaid amendment and readoption of Resolution No. 84 -13 shall not constitute nor be construed as a waiver of any violations existing at the time of adoption of this Resolution. -2- a h f THAT, should any section, clause, provision, sentence, or word of this Resolution be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the validity of this Resolution as a whole, or any parts thereof, other than the part so declared to be invalid. For this purpose, this Resolution is declared to be severable. THAT, this Resolution is necessary for the public health, safety and welfare.
