BOARD OF COUNTY COMMISSIONERS
COUNTY OF EAGLE, STATE OF COLORADO
RESOLUTION NO. 84- 4L
PUBLIC AUCTION OF PERSONAL PROPERTY
OF THE COUNTY OF EAGLE, STATE OF COLORADO
WHEREAS, pursuant to Sections 30- 11- 101(1)(c) and (e),
and 30- 11- 107(1)(a) and (e), resepectively, C.R.S., the Board of
County Commissioners of the County of Eagle, State of Colorado,
hereinafter referred to as the "Board ", is empowered to sell,
convey, or exchange personal property owned by the County of
Eagle, State of Colorado, and make such order respecting the
same as may be deemed conducive to the interests of the
inhabitants; and
WHEREAS, the Board desires to sell at a public auction
certain personal property owned by the County of Eagle, State of
Colorado, identified in Exhibit A attached hereto and
incorporated herein by this reference, for the reason that the
intended purpose and use of such personal property by the County
of Eagle, State of Colorado, no longer exists; and
WHEREAS, by Court Order dated April 23, 1984, the Eagle
County District Judge, William L. Jones, ordered the Eagle
County Sheriff to dispose of certain evidence as identified in
Exhibit B attached hereto and incorporated herein by this
reference, by sale to the highest bidder at a public auction
with the proceeds of said sale to be used to purchase additional
equipment for use by the Eagle County Sheriff; and

NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO:
THAT, the Board hereby authorizes the sale of that
certain personal property identified in Exhibit A attached
hereto and incorporated herein by this reference, to the highest
bidder at a public auction to be held Saturday, June 2, 1984,
commencing at 10:00 A.M. at the Eagle County Fairgrounds, Eagle,
Colorado.
THAT, such public auction shall also be for the purpose
of disposing of that certain personal property identified in
Exhibit B attached hereto and incorporated herein by this
reference, by the Eagle County Sheriff in accordance with the
Court Order referred to hereinabove.
THAT, the sale of any of the personal property
identified in Exhibits A and B shall be to the highest bidder,
with the proceeds from the sale of the personal property listed
in Exhibit A being placed with the Eagle County General Fund,
and the proceeds from the sale of the personal property listed
in Exhibit B being distributed to the Eagle County Sheriff for
use in accordance with the subject Court Order.
THAT, the Board, or its designated representative,
shall have the right to reject any and all bids tendered for any
specific item of personal property which in its sole judgment is
too low, unreasonable, or not conducive to the interests of the
County of Eagle, State of Colorado.
THAT, a notarized bill of sale executed by an
authorized representative of the Board shall be presented to the
purchaser concurrent with the sale of the respective personal
property.
THAT, all sales shall be by cash, certified funds or
personal check; however, all sales by personal check shall be
expressly subject to the clearance of the personal check prior
to the transfer of title.
THAT, all respective titles to the personal property
sold at the public auction shall be duly executed by the
Chairman of the Board at its regular meeting of June 4, 1984,
and thereupon released to the respective purchaser, excepting
therefrom those sales in which the personal check tendered has
not been cleared for payment.

IN RE: EVIDENCE HELD BY EAGLE COUNTY SHERIFF.

COMES NOW, John F. Healy, District Attorney for the Fifth
Judicial District, by and through his Deputy for Eagle County,
Chester H. Budz, Jr., and respectfully requests that the Court
issue an Order permitting Eagle County Sheriff to dispose-of
the items as outlined in the attached list which are presently
stored in the evidence vault of Eagle County Sheriff. And
further requests that the said items be disposed of by sale to
the highest bidder at a public auction, and thalthe proceeds of
the sale be used to purchase additional equipment for use by
Lagle County Sheriff,
AND AS GROUNDS THEREFOR, states and asserts that the items
are not needed for prosecution of any criminal cases, and the.
Sheriff has exhausted all avenues in attempting to locate the
owners of said property for return of these items.
