COUNTY OF EAGLE, STATE OF COLORADO
RESOLUTION NO: 84-3
APPROVAL OF SPECIAL USE PER ?MIT - Avon Lutheran Church
FILE NO: - ZS- 189 -83
WHEREAS, Steve Isom, i -plan, inc., did file an application
with the Eagle County Department of Community Development on
or about October 1, 1983, within the Residential Suburban Low
Density Zone District; and
I4HEREAS, a public hearing was held by the Board of County
Commissioners of the County of Eagle, State of Colorado, on
November 9th, 1983: and
WHEREAS, based on the evidence, testimony, exhibits, study
of the 'Master Plan for the unincorporated areas of Eagle County,
comments of the Eagle County Department of Community Development,
comments of public officials and agencies, the recommendation of
the Eagle County Planning Commission, and comments from all in-
terested parties, the Board of County Commissioners of the
County of Eagle, State of Colorado, finds as follows:
1. That proper publication and public notice was provided
as required by law for the hearing before the Planning Commission
and the Board of County Commissioners.
2. That the proposed special use conforms to the require-
ments of Section 2.09 of the Eagle County Land Use Regulations.
3. That the proposed land use will be compatible with
existing uses in the area.
4. That for the above - stated and other reasons, the pro-
posed zoning is in the best interest of the health, safety,
morals, convenience, order, prosperity and welfare of the
citizens of Eagle County.
'd0 ?;', THEREFORE, BE IT RESOLVED, by the Board of County
Commissioners of the County= of Eagle, State of Colorado.
That the application of Avon Lutheran Church. File "To:
ZS- 189 -83, for approval of a special use of Church, community
center, day care center and parsonage within the Residential
Suburban Low Density Zone District in the following described
unincorporated area of Eagle County be approved:
SEE ATTACHED EXHIBIT "A"
THAT the following conditions shall be placed upon this
approval and that violation of any conditions shall be the basis
for revocation of the permit:
1. An acceptable landscaping plan showing size, species,
and location of plant materials must be submitted
with the building permit.
2. Access from Lake Creek Road is not allowed.
3. Access is, as shown on the plan, from Edwards Village.
An additional access from Highway 6 may be acceptable
if the Board of County Commissioners review and approve
it and if it can be demonstrated that said Highway 6
access is safe, adequate, and conforms to all require-
ments of the Colorado Department of Highways.
4. There shall be annual review until such time as con-
struction is completed.
5. The Board shall review the final site plan prior to the
submittal of a building permit.
THAT the Board of County Commissioners directs the
Department of Community Development to provide a copy of this
resolution 'othe applicant.
MOVED, READ, AND ADOPTED by the Board of County Commissioners
of the County of Eagle, State of Colorado, at its meeting held

Legal Description
A parcel of land located in Section 5, Township 5 South, Range 82 West of the
Sixth Principal Meridian, Eagle County, Colorado; according to the Dependent
Resurvey of said Township and Range as approved by the U.S. Surveyor General in
Denver, Colorado on September 7, 1977, said parcel of land being more particularly
described as follows, to wit: Beginning at a point where the proposed Easterly
Right -of -Way of Lake Creek Road intersects the Southerly Right -of -Way of U.S.
Highway No. 6; a point from which the Northwest Corner of Section 5 bears
N.12014'38 "W. 2273.34 feet distant; thence along said Southerly Right -of -Way
of U.S. Highway No. 6 278.97 feet on the arc of a curve to the right having
a radius of 2821.00 feet, the chord of which bears S.79023'21 "E. 278.85 feet;
thence continuing along said Right -of -way S.76033'23 "E. 100.56 feet; thence
leaving said Right -of -Way and following an existing fence line S.19o59'46 "�
247.80 feet; thence continuing along said fence line N.74006'46 "W. 365.20 feet
to its intersection with the proposed Easterly Right -of -Way of Lake Creek Road;
thence following said Right -of -flay 66.99 feet on the arc of a curve to the
right having a radius of 479.77 feet, the chord of which bears N.14023'17 "E.
66.93 feet; thence continuing along said Right -of -Way N.18023'27 "E. 150.47
feet to the point of beginning, said parcel of land contains 2.017 acres,
more or less.
