BOARD OF COUNTY COMMISSIONERS
COUNTY OF EAGLE, STATE OF COLORADO
RESOLUTION NO. 84- /
RESOLUTION AUTHORIZING EXPENDITURES FROM THE
CONTINGENT FUND - SLIDE DAMAGE TO COUNTY ROAD 13 (EL
JEBEL HILL)
WHEREAS, County Road 13 at E1 Jebel Hill was seriously
damaged and destroyed by an Act of God, a landslide during 1983;
and
WHEREAS, the Board of County Commissioners of the
County of Eagle, State of Colorado, hereinafter called the
"Board ", has established a Contingent Fund, budgeted and
appropriated funds in that fund to provide for expenditures
caused by Acts of God, or the public enemy, or some contingency
that could not have been reasonably foreseen at the time of the
adoption of the budget; and
WHEREAS, the Board has determined that the landslide at
E1 Jebel Hill requires the expenditure of funds from the
contingency fund to restore the road to usable condition; and
WHEREAS, the Board notes that certain other natural
calamities during the course of the year including the unusually
severe run off which caused flooding and damage to the county
roadways and threatened other properties requiring extraordinary
measures including sandbagging causing unforeseen expenditures
in the amount of $38,750.00 which taxed the budgets of the
County Road and Bridge Department and the County Emergency
Preparedness Agency to the extent that with other normal
expenditures it is not possible for them to absorb the costs of
the landslide at E1 Jebel Hill.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of the County of Eagle, State of Colorado:
THAT, the Board hereby finds that part of Eagle County
Road 13 was destroyed by an Act of God, an act that could not be
foreseen at the time of budget and designates of the Contingent
Fund previously established pursuant to the provisions of
Section 30 -25 -107, C.R.S., as the appropriate fund from which to
pay the costs associated with the restoration of County Road
13. It is estimated those costs associated with the slide
incurred during 1983 will not exceed $25,000.00.
THAT, the Board hereby finds, determines and declares
that this Resolution is in the best interest and for the public
health, safety and welfare of the citizens of Eagle County.
MOVED, READ AND ADOPTED by the Board of County
Commissioners of the County of Eagle, State of Colorado, at its
regular meeting held the 3rd day of January, 1984.
