RESOLUTION
OF
THE BOARD OF COUNTY COMMISSIONERS
COUNTY OF EAGLE, STATE OF COLORADO
Release of Collateral - Lot 21 Buffer Creek Resubdivision -
Texas Construction Company
WHEREAS, Texas Construction Company, hereinafter referred
to as the ''Subdivider" did on November 13, 1978, submit an irrevocable
letter of credit to the Board of County Commissioners, County of Eagle,
State of Colorado, hereinafter referred to as the "Board ", in the amount
of One Thousand Dollars ($1,000.00) to guarantee the performance and
completion of certain landscaping with respect to Lot 21 Buffer Creek
Resubdivision i.e. Capstone Townhouses; and
WHEREAS, the Subdivider has fulfilled the terms of the letter
of credit i.e. completion of landscaping as per the plans submitted to
the County with respect to Capstone Townhouses; and desires the Board
to release said letter of credit;
NOW THEREFORE, be it resolved by the Board of County Commis-
sioners, County of Eagle, State of Colorado:
THAT, the Board hereby releases a certain letter of credit in
the amount of One Thousand Dollars ($1,000.00) with respect to Lot 21
Buffer Creek Resubdivision i.e. Capstone Townhouses;
THAT, the release of said letter of credit is pursuant to the
satisfactory completion of landscaping as per the plans submitted to the
County by the Subdivider.
THAT, the Board hereby finds, determines, and declares that
this Resolution is necessary for the public health, safety and welfare
in the County of Eagle, State of Colorado.
M0VED, READ AND UNANIMOUSLY ADOPTED at a regular meeting of the Board
of County Commissioners, County of Eagle, State of Colorado, held this
